So Tom DeLay dies and goes to wherever. Can he ask for a different judge? |

Tom DeLay is a self-proclaimed fundie who believes he's above the law. He wants a different judge. How many defendants get to pick and chose in this manner?
According to the scriptures that he claims to love so much, everyone is going to be judged by DeLay's Almighty deity. Ummm, Tom, what if you don't like THAT judge? Are you going to ask for a different one? And if so, exactly who would you like Him/Her/It to be? Maybe there's a Republican God and a Democrat God.

There is a point beyond which the justification for change of venue no longer applies, almost always when you're talking about a public figure or highly publicized case.

If there were "a point" beyond which a defendant was not able to exercise his rights, I'd say that America had fallen on bleak times, indeed.
That's DeLay talk, you know - "fuck him," and so forth. Remember when he decided that he knew better than the Florida courts?
Let's not let ourselves descend to their abysmal level. We're better than that. We respect our laws.

This is America.
The defendant can request a change of venue, if he can establish that the current venue is prejudicial to his case.
The defendant can ask the judge to recuse himself - but, as I was taught in law school, you had better be very, very sure of yourself before you do that. If you can't kill the king with one stroke, you're going to be in seriouz trouble when your first stroke misses.
Our courts are not houses of worship, except for those of us who regard the law as sacred.
