Why is DeLay judge-shopping if he's innocent and will be "exonerated"?? |
|
Edited on Sat Oct-22-05 04:49 AM by goodboy
After all his lawyer is a democrat and that doesn't seem to bother him...
And furthermore, if he is to be tried by a jury of his peers, will they request the political affiliation of each juror? Will they only allow repukes to sit on the jury?
IF these charges are "false and baseless" as DeLay claims, then why shouldn't he say, "I'll be proven innocent whether or not the judge is a dem or the entire jury is made up of democrats!"
Sounds to me like he's not innocent enough...

if the playing field isn't totally stacked in their favor. Exactly why DeLay authored the Texas redistricting, why they use Swift-Boat tactics, have Diebold in their pockets etc. etc. etc.
The farthest thing from their minds is a "fair trial", they want everything stacked in their favor before the starting gun goes off. I hope this backfires on the son of a bitch, BIG TIME! It's time for bug-man to get a taste of his won medicine.

2. playing to the RW crowd |

Honestly, DeLay doesn't stand a better chance with a Republican judge if that judge is a professional, so the political affiliation obviously serves no purpose as far as making the trial fairer. But the precedent that would be set if DeLay gets a Republican judge is that the first stage in any criminal case becomes for the defendant's lawyers to find out the political affiliation (or anything different from the defendant, ie. race, sex, religion) of the judge, and then impugn his integrity.
DeLay's lawyer made the motion, but probably doesn't honestly believe it'll be granted. The point was basically to scream to all the RWers out there "Judge is a DemocRAT!!! He's A DEMOCRAT!!!!" so when DeLay gets convicted--as he will be--the Faux News crowd can go around and say he was railroaded by a crooked Democrat judge and prosecutor.
DeLay doesn't actually want a Republican judge (if the judge is a professional) because then, when he's convicted, he won't be able to go around bitching that he was railroaded by Democrats. So it's quite obviously just a play to the RW peanut gallery.

Tommy Bugman the criminal that I suspect will be held in that Austin courtroom and Mr. Earle will be given the chance to present his evidence and a jury of peers will determine his fate. Simple, straight-forward and how justice is served to thousands each day. DeLay doesn't nor should receive any special treatment. It's bad enough this bastard has done some blatant attempts to taint the possible jury pool. My hopes are that if there is a chane of venue, it's moved to the Houston...where a bunch of Tommy's Astrodome friends could sit in judgement instead
The other trial is for the money and power. Bugman knows he needs to be portrayed as a martyr for as long as possible...even if he's convicted (of course it'll be a partisan judge & jury)...so he can keep his powerbase alive and going. If it's thought that he's toast and won't be back, his influence would have run out. Instead, he's still in charge...manipulating house rules and intimidating as usual. Plus, this helps his fundraising, as Bugman is sure to find a way to turn a profit out of his trial.

4. To be fair and to leave no doubt about the outcome of the case |

Delay does have a point, the judge has made political contributions to Moveon.org
I'm not real sure I would like to have a judge preside over a case as important as this if it were a democratic congressman, if that judge were making yearly contributions to say Pat Robertson 700 club.
To leave open an appeal because a judge would not recuse themselves may be a problem

6. Delay knows how the system works. |
|
His chances are as good as a black man being judged in a Southern Baptist county.
However, in this case, it's like a southern slave owner being judged by the freed saves.
The system isn't fair, and never has been. But if Delay can judge-shop, so should we all.
