Bush Won't Release All Miers Records
President Bush said Monday that he will not release any records of his conversations with Supreme Court nominee Harriet Miers that could threaten the confidentiality of the advice that presidents get from their lawyers. "It's a red line I'm not willing to cross," Bush said. Both Republicans and Democrats on the Senate Judiciary Committee are demanding more documents on Miers, including from her work at Bush's counsel. "People can learn about Harriet Miers through hearings, but we are not going to destroy this business about people being able to walk into the Oval Office to say, Mr. President, this is my advice," Bush said after a meeting with his Cabinet.


Bush did not directly answer the question that was posed to him by a reporter at the end of the meeting - whether the White House is working on contingency plans to withdraw Miers nomination in the face of opposition to her from liberals and conservatives. Instead, he said that she is an "extraordinary woman" and that he understands people want to learn more about her.

But the "confidential records" withdrawl scenario is most likely.

5. a truly idiotic rationale. he volunteered her up for nomination!
it's not like she's being hauled in front of a congressional hearing for some adversarial reason -- you might understand the defensiveness there.

but no, he chose to get himself into this, he know there would be hearings and requests for papers, and he could have -- should have -- entirely avoided release of any papers through simply and obvious act of NOMINATING SOMEONE ELSE :eyes:

6. At some levels he is right.
Work product directly related to presidential advice is probably off limits. But anything else she has done bears directly on he capacity to adjudicate fairly and impartially. They opened the Door by nominating her. Same would be true for Gonzales.
