PLAMEGATE Leakers Guilty of TERRORISM as defined in U.S. Code?
Edited on Mon Oct-24-05 11:28 PM by berni_mccoy
If justice is served and those responsible are indicted, could they be guilty of TERRORISM as defined by U.S. Code of Law TITLE 18, PART I, CHAPTER 113B, § 2331 ( http://www4.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00002331----000-.html )

(5) the term “domestic terrorism” means activities that—
(A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State;
This is the actual leak itself. Leaking the name of an undercover agent is dangerous to human life and is illegal.

(B) appear to be intended—
(i) to intimidate or coerce a civilian population;
(ii) to influence the policy of a government by intimidation or coercion; or
(iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and
Here, the acts were intended to silence opposition to the war and thus intimidate the civilian population, influence the behavior of the media and CIA and caused the US to wage a war we would not have supported that caused mass destruction in Iraq and has severely hurt our efforts in the War on Terror and in stopping the proliferation of WMD.

(C) occur primarily within the territorial jurisdiction of the United States.
The act occurred in the U.S.

Is this the surprise CHARGE that is awaiting members of the White House? Will these people be labeled as they truly are: AS TERRORISTS DEFINED BY US LAW?

Thoughts?

1. If they were actually equally accountable under our laws
Best we can hope for is a perjury or two and a few resignations.

3. We've all suspected or known they were traitors
But here is an actual law they broke, one they helped expand in the Patriot act. The crime, if they are indicted for it, should be included in the charges...

That is to say, if they are indicted for illegally leaking a covert agent's identity, then they ALSO need to be indicted for TERRORISM!!!

4. Well, that sure would be poetic justice...............
can you imagine? March them all off to Gitmo for the remainder of their days, no attorney, no family notice or contact..........treat them like they have treated every other detainee.

:bounce: :rofl:

6. I think Abu Gharib would be more appropriate...
and letting the newly trained Iraqi Soldiers keep guard. Now that would be poetic.

7. Morning Kick
Again, if these guys are indicted, even for perjury, then they qualify under this law.

9. Oh yeah!... If anyone had the balls to do it, too... it would be Fitz...
Shame it would take "balls" to nail their asses to every charge that applies...especially this one. It would apply to everyone else in this country, according to those who wrote/designed the Patriot Act, as it "should" apply to them, EQUALLY.
