Cheney was part of the Administration and the conversation was within the confines of providing information regarding the findings of the trip.
Where the crime is committed is when an outside source receives the information.

Cheney say that Cheney said he got the info from Tenet, as I recall. That's hearsay several times removed. (Even if Cheney did tell Libby that he got the info from Tenet, it doesn't make it true.)

If he was just briefing the Vice President as requested, then there's absolutely nothing improper about it.
But, if there was evidence that Tenet was aware of, and abetting, the WHIG-OSP plot to paralyse and punish the CIA weapons experts who opposed the build-up to the Iraq war, he could very well be indicted for conspiracy.
