Indictments Coming Tomorrow; Targets Received Letters Today

An uber-insider source has just reported the following to TWN:

1. 1-5 indictments are being issued. The source feels that it will be towards the higher end.
2. The targets of indictment have already received their letters.

3. The indictments will be sealed indictments and "filed" tomorrow.

4. A press conference is being scheduled for Thursday.


The shoe is dropping.

Indictment

Before the target of an investigation is arrested, prosecutors generally will take the evidence they have gathered to a grand jury. Grand juries are composed of 16 to 23 citizens. Agreement by a bare majority is required to find probable cause exists that a crime was committed.

Grand juries are formally supervised by a district judge, often the chief judge, but for all practical purposes they function day-to-day under the auspices of the U.S. Attorney's Office. Only prosecutors present evidence before a grand jury, and a finding of probable cause – necessary to issue an indictment – is a relatively low standard of proof.

The indictment lists the crimes the defendant allegedly committed and describes the facts the government believes support those allegations. It is a roadmap to what the prosecution intends to prove at trial. Grand jury indictments are returned to the district court – usually to a magistrate judge – in a sealed court hearing. Indictments generally are unsealed after a defendant is arrested.

A criminal case also can begin without an indictment. In these cases, the lead investigator swears out a criminal complaint, called an "information," setting forth the same kinds of allegations and facts that would be contained in an indictment. Absent an indictment, the prosecution must convince a judge that there is probable cause to proceed with the case. These hearings are held in open court after the defendant has been arrested in a felony case. A defendant can agree to waive indictment and proceed with the case based on the criminal complaint, or can demand that the prosecutor seek an indictment.

Going off of what David Corn wrote ...

Though it may be frustrating (and may mean not celebrating Fitzmas this week), it sounds to me like sealed indictments could be a sign that there is much more to come.

Imagine that Fitzgerald has the indictments sealed until after a new grand jury is impaneled ... because there is much more investigation to do now ... because the investigation is headed directly at Bush and Cheney.

I want indictments, now. But if it means taking down Bush and Cheney and Rice and Rumsfeld -- I'll wait for as long as it takes.

34. Indictments are often sealed
if the prosecutor is hopeful of flipping someone. The person is told of the indictment and given a last chance to come in and cut a deal.

Also, sometimes indictments are sealed because revealing them might compromise investigations of other people.

Just because the info isn't public shouldn't relieve the targets of their obligation (unless they REALLY want to hurt their Dear Leader) to resign ... ???

remember, an indictment, like an impeachment, is essentially an accusation, and the recipient is considered "innocent until proven guilty."

After the convictions, then we'll insist the bastards resign.

Evidence of suspicion isn't proof of anything. Yet.

I imagine Fitz will ask for the grand jury to be extended or for a new grand jury to be empaneled.

I also imagine that Fitz probably does not want to seek indictments just yet but has to show the district court that there is good reason to extend the probe beyond two years and indictments would do that.

According to what's been said here sealed indictments mean either that Fitz wants to flip somebody or that he needs to empanel another grand jury to complete the investigation, or both. Either way, it would appear that more indictments may be coming and this investigation is not over.

This is probably the best news we can hear. It means that Fitz ain't stopping with Rove, Libby, and other staffers. I'll bet the WH is in utter chaos today.

Feel sorry for the Chimp. Send him bottles of Jim Beam to help him cope. Poor guy's gonna need a big supply.
