Sealed Indictments. So the new spin will be: "Stop all speculation...

about who was or wasn't indicted because we don't know and it's just not fair to the defendants."

BTW: How can letters have gone out to the defendants, and yet have the indictments sealed? Aren't sealed indictments usually used to help the prosecution, NOT to shield the defendants?

5. My question too..
I just posted on another thread wondering if Karl et al will just keep working because no one knows who's been indicted, and they'll never tell.

Isn't there a lawyer here who could explain this?

2. The sealed indictments
Might be because the case deals with a lot of classified information that can't be made public.

3. So we'll get to know who was indicted, but not the details of why?
Edited on Tue Oct-25-05 06:25 PM by Junkdrawer
Is a sealed indictment an all-or-nothing thing?

6. We actually need an attorney to address this.
I think a target letter is a warning: "You're a suspect." Puts them on guard, in a different category. It doesn't mean an indictment is wending their way.

Sealed indictments are sealed until the arrest is made. It's to reduce flight risk, I think, as well as to let negotiations occur and more fact-finding take place.

There are no defendants. There are only witnesses and targets, prosecutor and jury. There is no real prosecution, as such, and the 'defendants' get to present no defense.

7. Prediction: If we get sealed indictments and no announcement of who...
was indicted, the level of paranoia will skyrocket among those who believe Cheney had a hand in 9/11.

And that would include me. :scared:

9. As if we're gonna sit & wonder if the Prez has been busted for TREASON.
IIuc, they're only sealed until the shitheads are arrested.

Any attorneys care to clear this up?

10. From the Federal Rules of Criminal Procedure:
Edited on Tue Oct-25-05 07:18 PM by Junkdrawer
(4) Sealed Indictment. The magistrate judge to whom an indictment is returned may direct that the indictment be kept secret until the defendant is in custody or has been released pending trial. The clerk must then seal the indictment, and no person may disclose the indictment's existence except as necessary to issue or execute a warrant or summons.

So it sounds like "Sealed Indictments" Wednesday, defendants arrested (and released??), then a full news conference Thursday.

11. Wednesday Update: Looking like sealed indictments today.
http://www.cnn.com /

Special Counsel Patrick Fitzgerald is not expected to make a public announcement today about the CIA leak investigation, a source with knowledge of the investigation tells CNN. Experts say it's possible the grand jury still may consider indictments and, if it votes to return one or more, the indictments could remain under seal and be made public later.
