Fitzgerald has also asked the jury to indict Libby on a second charge: knowingly outing a covert operative, the lawyers said. They said the prosecutor believes that Libby violated a 1982 law that made it illegal to unmask an undercover CIA agent.

5. The treason bit was always a massive reach.
As for the espionage act, prosecutors are expected to go with the law that best fits the crime. Besides, he doesn't have to be done investigating yet. If he has the goods for the 1982 law and perjury and obstruction of justice, then he goes with that, for now.

This is not the end of the world.

8. Well, covert is the plain word we use, not the language of the law.
The law says, someone whose identity the US is taking active measures to conceal. That's broader and less easy to sneak around than the word "covert". There's plenty of room to nail an official with rightful national security clearance to know that Plame's ID was being protected by the government (not just the CIA, *THE GOVERNMENT*) who releases her identity anyway.

And Fitz knows all that and must have enough to get Libby on this.

In other words, we know the goods exist, we just don't know exactly what they are.

13. You have to wonder if they were going to just charge him with
perjury and the like - until Repukes made a big stinck about "the original crime".

Now it looks like Libby could be facing more time.
