What's this talk of Fitzgerald supposedly having indictments and |
|
going to the indictees stating you've got this indictment, do you want to cut a deal or we can go back for more? I heard this on two shows today and I am assuming this is just chatter because no one knows what's going on. But can a prosecutor issue an indictment but call it back if a deal is cut?

6. I don't think a prosecutor can literally indict then un-indict. |
|
But he can tell subjects of the investigation that he can indict them if they don't talk.
Or that he won't pursue existing indictments if they talk.

7. Defendants can cut deal, even during trials. |
|
They just have to have the prosecutor and the judge agree that the deal is legal.

11. Cutting deals up front is precisely |
|
why these guys are represented at the early stages of their entanglement with the investigation. Wouldn't you rather have them file at the lowest possible level rather than make it look really gruesome by throwing in all those other charges that bring the standard sentence range way up.
The real clincher will be who pleads straight from Jump Street. Those are the ones whose egos are not so big as to make them believe they won't be found guilty.
