Harriet Miers Was Borked

As progressive Democrats, we owe a duty to the venerable (and a wee bit racist) Mr. Bork to point this out.

I talked about it on my blog, but here's the upshot:

Supreme Court Nominees "Borked" By Democrats: 1
Supreme Court Nominees "Borked" By Republicans: 1

What this means is that we never have to hear the phrase "ideological litmus test" from Republicans again. They've just employed one, so now they can't decry the concept.

And we should never have to hear Bork's name again, either. They just Borked their own nominee, so now the term has lost all meaning, and the man himself, all relevance.

Bottom line: You eat your young, you lose the right to decry cannibalism.

Sound about right? I think so.

Of course Ironically one of the judges calling the loudes for her Borking was former Judicial Nominee Bork.

7. I'm not so convinced.

Yes, there was alot of discussion about her personal ideology, BUT- she was also shockingly unqualified and her nomination came soley because of her relationship w/ the Prez. There was alot not to like about the Miers nomination, so saying she was Borked doesn't begin to cover it.

Constitution as it did his neanderthal view of that document.

The big elephant in the room, the thing everyone forgets in the mists of time, that made the GOP as well as the Democrats VERY uneasy about Bork, was the fact that he was the COX SACKER.

Bork was the guy who, at the behest of RICHARD NIXON, FIRED Archibald Cox after Elliot Richardson refused and resigned, and his deputy refused and quit as well.

A guy who is a tool of a criminal President who resigned to avoid impeachment is not the sort of guy you want on the Supremes. Harriet's problem was that she had insufficient history, was unprepared in her informal interviews, did not answer questions with sufficient knowledge and rigor, and had all the hallmarks of a toady. What Bork did, cheerfully carrying out that illegal order, was in and of itself criminal.

For this reason I can't see the two as equivalent, but the point of argument is useful when dealing with a rightwing ideologue.

19. IMO, Bork lost many repubs b/c he said there is NO right to privacy
in the constitution

at the time, many repubs believed in privacy

(this is the way I remember it; when Bork said that, the game was over.......RW revisions of history never mention that; they claim it was b/c he had a record......that's why repub nominees do NOT want a record, do NOT discuss their record)

20. Oh, certainly, the STATED reasons for rejecting him had to do with his
'judicial philosophy'--no argument from me, there. But in the back of everyone's mind in the Senate (which is chockerblock FULL of lawyers) is that this clown went and fired an appointed Special Prosecutor just because the guy was getting too close to the truth. They saw their fellow lawyers, the AG, Richardson, and his Deputy, Ruckleshaus, resign because the rule of law was being flouted.

I just got the sense that Bork playing good Nazi to Nixon, and circumventing the justice system, did not set too well with those guys at all.

Bork had a paper-trail as broad as a superhighway. Miers had almost none - less than a snake-path. Bork was torpedoed because of extensive evidence of extreme ideological views - paramount to a psychosis. Mier's was torpedoed because of the almost complete absence of evidence - along with ambiguity. Bork was intellectually gifted. Miers is intellectually-challenged. She's the "anti-Bork" ... the Pong to the Bork Ping. Bookends.

What her withdrawal does is almost assure another Bork nomination ... which might narrowly pass this time.

I agree with Steve Roberts' assessment. This betrays the hypocrisy of the far right. Rather than eschewing court activism, they're insisting on it. Lacking the votes in the Congress to overturn Roe v. Wade, they demand "legislation from the bench" to overturn it. The far-fundie-reich is overtly imposing not only a litmus test, but a litmus test coupled with a promise of judicial activism. This is the heart of fascism - any hypocritical means to impose the will of an intolerant, jack-booted minority/plurality on all others.
