He didn't try to cover up. He likely told the prosecutor everything he knew and Fitzgerald was able to corroborate his statements.
OR...

Reading the indictments, one of the specific lies that they are going after Scooter on involves Scooter's description of a conversation he had with Russert.
The interesting question is whether they have any documentary evidence (notes, etc.) to back up this claim or whether its a he said/she said thing. I have to assume they've got something more than conflicting descriptions from Libby and Russert.
