Because it's enumerated in the actions taken by the defendant and shown how he ::: drum roll ::: osbstructed justice, in this case, by lying.
What an unbelievably stupid thing Libby did.
And he's a lawyer ................

I'm just now checking in and have missed your take on this whole deal. Have you any specific thoughts on this?
Do you think there are others who were served letters of indictment who are plea bargaining as we speak? Do you think Cheney will take the fall for Bush? Seems to me Cheney is fairly well implicated in the Scooter indictment.
How long do you think this will all take? Do you think it is right for those under indictment to keep working at their jobs?
Answers man! I need answers!

Here's the deal.
Forget the terminology you heard, "letters of indictment," because that's linguistic bullshit that means nothing here.
Are there others who have been indicted? I don't know. No one knows.
No one knows anything. That's all anyone knows.
Will Libby sing on others? I like contemplating this, because it opens up such delicious avenues of potential. But, given his loyalty, I don't know.
There's no indication from the Libby indictment that Cheny is implicated.
Those are the answers, toots. That's all there is right now. Libby's in serious deep shit, and Fitzgerald isn't finished.
It's just begun, I think, and it's fascinating.

When you're just plain out lying, you're committing perjury. But when you piss off the prosecutor by making up stories, falsifying records, threatening witnesses, etc. - basically leading the prosecutor down the wrong path and WASTING HIS TIME, you're committing obstruction of justice. Yes, people can be pretty imaginative when cornered, and obstruction can take many, many forms.
