16. Here is the excerpt:
Libby told me that he used to be a lawyer and that "to be safe" our attorneys should talk and if it was O.K. with them, it was O.K. with him. So the following week my attorney, Floyd Abrams, spoke with Libby's lawyer, Joseph Tate, and they hammered out the details of the waiver. http://www.time.com/time/magazine/article/0,9171,1124287-2,00.html

2. Cooper is in it with them. Wasn't Ted Olsen his lawyer?
And they made sure the truth didn't come out before the election.

Remember, Fitz said he wished he had the info he needed back in Oct. 2004 instead of Oct.2005.

7. Why did you say Olsen was his lawyer?
If he wasn't, you're planting the mis-information in people's minds that he was.

8. I'm quite sure that Ted Olson is part of this.

I wouldn't say so if he wasn't - planting disinfo isn't my thing.

22. I apologize if you are correct and I'm not.
I found two blog references to Olsen being Cooper's attorney.

Did he fire him?

Someone named Sauber is the one who went to court with Cooper and who goes on television to talk about the case.

24. I understand, but Olson would be careful not to get his face out front on
this, and would use Sauber as the spokesman for Cooper...remember, the RW media machine spun this episode as a liberal media thing, when WE all know that Miller and Cooper and other reporters were tapped BECAUSE of their friendliness to the WH.

If Olson was OBVIOUSLY involved it would draw far too much scrutiny for his WH connections.

No wonder Cooper is soft-peddling this shite in the TIME article.

14. C'mon kentuck...most of DC press knew Rove and Libby leaked for 2 years
and still allowed GOP operatives to plant stories calling Wilson a liar and just a campaign hack for Kerry throughout the election.

The press was very much a part of enabling BushInc on this story EVERY STEP OF THE WAY.

23. hello. Floyd Abrams was his attorney ... see post 16 and follow it...geeze
can we get our facts straight that Ted Olsen was being considered ONLY to argue the case before the SCOTUS if that Court took it ... but on all other legal pleadings for Cooper and Miller up to that time, Floyd Abrams was their attorney of record; then, when SCOTUS declined to hear the case, and confusion reigned about noncoerced waivers from Rove and Libby, Cooper called these 2 up and got what he needed, while Judas Miller hired Bob Bennett who then at greater length negotiated with Libby; don't forget, that after Fitz "urges" Libby to move on Miller's personal waiver request, Floyd Abrams writes a dutch-uncle letter to Tate (Libby's attorney) reminding him of his legal opinion about Libby's previous waiver having some pseudo coercion in it. Let's face it, Abrams has well caught on to the various Miller and Libby dog/pony shows, but for Cooper it was quite straight forward.

4. Cooper's story: Lawyers met 'to be safe' - cook up story
Most of it was on the record, but part of it wasn't, and I wanted to see if I could get your permission to talk about the part that wasn't on the record." I told him that I would tell the truth about our conversation. On Aug. 23, I had a tuna sandwich and gave a deposition in Abrams' Washington office about the conversation. The Wilson part that really interested Fitzgerald was tiny, as I told TIME readers.

17. I don't know, but there could be a problem here.
Edited on Sun Oct-30-05 05:36 PM by JDPriestly
The attorney client privilege would not apply to consultations between Libby or Cooper and their attorneys if their attorney or attorneys was or were aiding in fraud. So, it depends, but the privilege as to confidentiality of the communications between each of them and his attorney could be in jeopardy under certain circumstances. I don't know enough to know if those circumstances exist here. We may find out. Maybe we won't.
