Court OKs Alabama Ban on Sale of Sex Toys

BIRMINGHAM, Ala. (AP) - A federal appeals court Wednesday upheld a 1998 Alabama law banning the sale of sex toys in the state, ruling the Constitution doesn't include a right to sexual privacy.

In a 2-1 decision overturning a lower court, a three-judge panel of the 11th U.S. Circuit Court of Appeals said the state has a right to police the sale of devices that can be sexually stimulating.

The American Civil Liberties Union, which represented merchants and users who sued to overturn the law, asked the appeals court to rule that the Constitution included a right to sexual privacy that the ban on sex toy sales would violate. The court declined, indicating such a decision could lead down other paths.

``If the people of Alabama in time decide that a prohibition on sex toys is misguided, or ineffective, or just plain silly, they can repeal the law and be finished with the matter,'' the court said.

``On the other hand, if we today craft a new fundamental right by which to invalidate the law, we would be bound to give that right full force and effect in all future cases including, for example, those involving adult incest, prostitution, obscenity, and the like.''

JUNE 24--While seated on the bench, an Oklahoma judge used a male enhancement pump, shaved and oiled his nether region, and pleasured himself, state officials charged yesterday in a petition to remove the jurist. According to the below complaint filed by the Oklahoma Attorney General, Donald D. Thompson, 57, was caught in the act by a clerk, trial witnesses, and his longtime court reporter (these unsettling first-hand accounts will make you wonder what's going on under other black robes). Visitors to Thompson's Creek County courtroom reported hearing a "swooshing" sound coming from the bench, a noise the court reporter said "sounded like a blood pressure cuff being pumped up." Thompson, the complaint charges, even pumped himself up during an August 2003 murder trial. The AG's petition quotes Thompson (pictured above) as admitting that the pump was "under the bench" during the murder case (and at other times), but he denied using the item, which was supposedly a "gag gift from a friend." that no person in Alabama would want to watch me having sexual privacy.

Does sexual privacy include baby wipes? Does sexual privacy include nail polish? Does it include bath salts? Does it include body lotion? Does it include people other than myself, or do I have to be alone to have sexual privacy? But that doesn't count, right? Alone or with another person? Or does it mean that if you are alone and thinking of another person, that is just the same as being with another person? And what if, in your imagination, you use bath salts?

I find this sort of reasoning confusing, and more than a little bit silly. I think these people want to be peeping.

So, all together now, do something naughty.

to be fair, the law only banned the sale. Does that mean if they buy it in Georgia they can bring it in to Alabama to use it?
