would be in order rather than incarceration. Make the fine large enough and no one will do this. Prison should only be a last resort and since this is a crime of very minor significance (spam is a nuisance, yes it clogs up the bandwidth passing on lots of monetary cost and lost productivity blah blah blah), I don't see how a large fine would be out of line. Our leaders and media have conditioned us to think "Lock em up and throw away the key" without thinking about the consequences of that.
