My Nephew finally caught a break with the "Just Us" system |

after ten years of being crushed in the wheels of the system, the judge presiding over his latest parole violation case:
1) declared him incompetent to stand trial and sent him to a state psychiatric hosptial for treatment
2) is questioning the charge that started this nightmare in the first place: making a terrorist threat to the police.
the judge is questioning why several policemen with guns felt there lives were in immediate danger because of threats made by a handcuffed teenager with a history of mental illness.
this is the best news we've had in ten years since my nephew was first diagnosed with schizophrenia and took his granfather's car without permission. he was delusional from not taking his medication, so he told the police his gang buddies would get them. note: my nephew had a priviledged life before all this began, and was not a member of any gang. a part of his illness is his delusions of being "a big man," and unfortunately the system has probably done more to introduce him to gangs since all of this started.
his grandfather didn't press any charges, but the DA pursued the terrorist threat charge...and thus the nightmare began.
i am looking for an organization to assist my nephew. over the years, we have contacted everyone from the ACLU and the NAACP...to no avail.
the judge will make his final decision, afrer reviewing the case, in early november, and we are hopeful that my nephew's imprisonment will finally be over, and that he will finally get the help he needs.
any ideas or suggestions? thanks in advance.

all of this started when he was still a juvenile, but he was charged as an adult for the terrorist threat, which is apparently a felony.

Seems like if you're in your late teens and commit a crime, you're more likely to be charged as an adult if you're black. Certainly not right, but I'm not surprised in the least.

the assumption is that every young black man must be affliated with a gang. his mental illness didn't make any difference, nor did the fact that he had never been in any trouble before, and that he was an honor student before the onset of the schizophrenia :shrug:

i'd love to hear from some attorneys about possible legal options if the case is tossed by the judge.
