Is Bob Novak Going to get a Lawyer?
Or is he going to take 'Personal Responsibility' for his 'Irresponsible Actions'?

October 3, 2004

Bob Novak had the ultimate unfortunate incident of breaking his hip last week.

I personally feel for the guy, breaking your hip is serious, and being up in years as he is, it doesn't help the healing process, but with proper care, at home nursing, extensive therapy, he should pull through.

But Bob Novak has been pitching one talking point during Bush's Court Appointed Presidency that strikes a nerve with me, and many, he has been talking in a negative way against 'Trial Lawyers and Frivolous Lawsuits'

From the report I read, Bob was in staying at a hotel and was taking a shower and fell while in Florida, on assignment to spin for the right the 1st Presidential Election for his employer, CNN News.

This opens a whole Box of Legal Issues. Does Bob's injury fall under a 'Workers Compensation' Claim? If so, did he have to wait to get approval from the Workers Compensation Insurance Company before he was able to get the operation he needed to fix his hip?

If it was a Workers Compensation Claim, then Bob Novak is going to be in the position to get a settlement from that Workers Compensation Insurance Company, and for a Broken Hip, I am sure that payment is going to be substantial.

In order to have such a Compensation Claim awarded, Bob is going to have to get himself a Lawyer, one of those tradesmen of the law that Bob has been knocking for the last few years.

Now, what if the Workers Compensation Insurance Company has a Cap Limit to the Award that is given to a worker injured while working, and Bob seeks getting a Lawyer that doesn't just handle Workers Compensation Claims, but a Lawyer that Sues companies for neglect.

Bob Novak could have a very strong argument that the hotel he was staying in was at fault for not supplying adequate bath mats, or that the adequate bath mats that should have been there were not there from the carelessness of the cleaning crews who are in charge of making sure adequate bath mats, along with other standard sundries that are expected to be available to patrons in this and other hotels.

What if, the bath mat that was authorized by the hotel as standard issue was not a bath mat at all, and there was nothing underneath that bath mat that would prevent it from slipping as a customer of that hotel would step on it getting out of the bath or shower stall. Then, Bob Novak would have a legitimate issue to substantiate a lawsuit to this hotel.

But then, that would fall under the terms, 'Frivolous Lawsuits' in some reformers eyes.

Bob has been living in modern day living quarters for a very long time, surely at the age of 73 he should know by now how to take a shower, shouldn't he?

He might have slipped on some soap? Is that what he might say, well what was the soap doing on the floor of the bath / shower stall? What, he dropped it, oh come on he should have picked it up immediately, shouldn't he have? Or did he slip on the shower floor because it was slippery, then that would make him careless for not checking to see if it was safe to get into in the first place, right?

Or, was Bob Novak distracted by his Cell Phone? Did that Cell Phone of his ring with that ' very important call he was expecting' while he was in the shower causing him to quickly spin around resulting in him losing his footing and falling down?

Bob Novak, a guy who just recently jumped out of a plane and parachuted down to the crust of the earth from thousands of feet in the air without a hitch, successfully landing with a big smile on his face, falls while taking a shower in a hotel, oh come on. It was obvious neglect on his part, total lack of personal responsibility for not making sure all the safety conditions were in order before getting into that shower stall. He is now laying on his back, sucking off the system. Now, those poor struggling Insurance Companies are now being forced to pay out thousands of dollars, to the doctors, the hospitals, the pharmacies, and ambulance company, all stemming from the direct irresponsible actions of Bob Novak.

Aren't payouts like these the reasons why insurance companies have to keep raising their rates to Americans, from irresponsible actions taken by citizens who should have known better to begin with and now, are putting these insurance companies in the position of having to pay for all the expenses that are required by state laws to ensure that a patient is given the necessary treatment to recoup from their self inflicted injuries.

And worse yet, Bob is going to wind up needing a Lawyer, one of those 'Blood Sucking Leaches who Shake Down Legitimate Insurance Companies' to represent himself in the court of law to get what he has coming, all resulting from Bob's personal irresponsibility.

All of these issues are a direct contradiction to the talking points of the Republican Party and Bob Novak himself from statements he has made on numerous occasions on CNN's Crossfire. And as George Bush's Re Election Campaign goes from town to town, state to state, telling the American People that reform is needed and people need to take responsibility for their own actions, Bob Novak, one of the Biggest Cheerleaders of the Republican Party's Talking Points, is now, 'One of Them' who are making it harder and harder for those poor insurance companies that they are 'oh so worried about'.

Bob Novak didn't just add to the burden of the insurance companies either, no, his irresponsible actions also added to the daily burden of Overcrowding in the nations Hospitals Emergency Rooms. How many people had to be subjected to having to wait a little longer to see a doctor because of Bob Novak's Arrival to whatever hospital he was sent to by the Ambulance that took him there. Worse yet, how many people having a heart attack, or being hit a car, or having a seizure had to wait a little bit longer for an ambulance to come and take them to a hospital for urgently needed emergency care because of Bob Novak's irresponsible actions causing him to tie up a crucial Ambulance otherwise known as an Emergency Response Vehicle?

The more you think about it, Bob Novak owes the People of Florida an Apology. HIs failure to be responsible caused the taxpayers thousands of dollars, and quite possibly could have caused the unneccessary death of some Floridian who had to wait for help because Bob was 'clogging up' the system.

If Bob Novak does wind up getting a Lawyer, and puts in a claim to an insurance company to pay for any medical bills or submits a lawsuit for personal damage it would equate nothing less than Hypocrisy.

1. We all know a good trial lawyer, don't we?
Reckon John Edwards would take his case pro bono? Or should he sock it to him for millions and millions, and millions??

2. Thats the point, Novak should be apologizing...
Novak should be apologizing to the people of Florida for Clogging up the system from the direct results of his irresponsible actions.

These are the Republican talking points, and its time they are rammed right up Bob's Ass if you ask me.

I know what it is like to have to wait for an ambulance when you need one and there are none because they are busy taking care of other people.

Everytime one of these Republican Cornballs are on TV , they are always saying, 'you have to take personal responsibility'.

Was Bob reaching for his cell phone? Did he over sleep and was rushing, I mean the guy is 73, jumping out of planes, he should know how to take a shower without falling !!!

3. What really happened...
I believe what really happened that while in a feverish fit to out all other reporters whom had even hinted that Senator Kerry had handily won the debate, he simply ran into himself coming back.

*shrugging*
