Arrrrrrghhh!!! Welcome to Pottersville!!!
I am very angry with Bank of America.

I made a deposit, a large one, in cash in the ATM(stupid, stupid), and they claim they never recieved it.

I filed a claim for this transaction, and they conducted an investigation. Guess what? They say, after their "thorough investigation", they are denying my request to return the money!

I have a reciept from the (diebold) atm, and in their "investigation",they didn't ask for that, or talk to me about the deposit, or as far as I can tell, review the tape of the deposit from the ATM camera. Nope. They report that they found no envelope and no loose cash, and that's that.

I called, and recieved information on how dispute this further, but my direct deposit check has already passed the point of no return, according to my payroll dept. They will deduct the amount from my acct. when that is deposited Friday.

I hope I get my money back. Either way, After this is over, I'm done with them.

Anyone have any suggestions on how to proceed to resolve this quickly? Thanks.

I am going on vacation and need to have that money. I have proof I deposited it. They are practically accusing me of theft, IMO.

Arrgh!

Start with your state's AG...they might have some referral or ideas for you. That ATM has a thief. Or the envelope is stuck in the machine. ask what their idea of a 'thorough investigation' is.

with an amount claimed for the transaction.

That does not constitute proof that that amount was actually in the envelope.

However, since the transaction information is printed on the envelope by the ATM at time of deposit (in most ATM's you can hear it), there should be some kind of tracking for the envelope if only for their own security/theft protection.

Many envelopes have a line for specifying Cash amount and/or a checkbox to indicate that the deposit includes cash.

What are they claiming was in the envelope and have they investigated the person who opened it. That should be tracked also.

Does the bank have an ombudman ?

Added:

You should followup and insist they track the specific information on the ATM receipt or prove that they have.

IS there any possibility you used a card for a different account (that is not connected to the one in question) and thus deposited in the 'wrong' account ?

They claim they have no envelope. I used my standard ATM Card.

Good idea about the reciept tracking, though.

6. Make sure you dont let them have the original receipt

since they have already proven themselves adept at losing things. Give them a photocopy and make one for yourself, just in case.

Keep copies of all communications with them and notes - including peoples names, date, time, etc. - of all verbal communications. You might consider using certified/registeered mail for things you send to them.

If the receipt indicates a deposit then I am almost certain it would have had to process an envelope or cancel the transaction. The onus should be on them to document what happened to that envelope and/or the contents or take responsibility for the loss. They can afford it.

No chance they get the originals.

I forgot to get the name of the lady I spoke with who gave me the number to dispute their investigation. I will from now on.

Registered mail definately.

They are supposedly sending me the documentation they used to reach their conclusion. I am very interested in seeing what they consider an investigation.

I don't know if banks are immune from small claims actions - especially collections attempts - (might check Nolo press web site and books) but it might be a possibility, especially if they fail to send someone to defend the action and you get a default judgment.

If you can prove the deposit (though not the amount actually in the envelope) and they fail to investigate it sufficiently then you might get a sympathetic judge.

8. was this a cash or check deposit???
if it was cash...your screwed...even with a receipt...

If it was a check...go to the source and ask if it was cashed...if so it can be traced...if not..have them cancel it and get another check in it's place.
