1. Bushie Couldn't Get Anyone Confirmed
this late in the game anyway. Too many minority rights in the Senate. Dem's would bottle it up, filibuster if they had to stand at their desks, reading the Manhattan phone book.

14. Vacancies on the Court are Always Unforeseen
since the Justices serve for life. Either they die, or they retire, usually shortly before they die.

It's always the same process. The Jusstice dies or retires, then the sitting President appoints. The Senate confirms or does not confirm, on a straight up-down vote. But the Senate can bottle it up for months in the Judiciary Committee. And then the filibuster rule applies to any floor vote.

19. Theoretically true,
but it's never been done (that I know about). The Senate still has the right to confirm or deny confirmation:

The appointment power:

Art.2, sec.2, para. 2: "He shall have Power, by and with the Advice and Consent to the Senate . . . and shall nominate, and by and with the Advise and Consent of the Senate, shall apppoint . . . Judges of the Supreme Court."

The recess appointment power:

Art.2, sec. 2, para. 3: "The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the end of their next Session."

the constitution requires the advice and consent of the Senate. If he even DARED to attempt a recess-appointment, it's a temporary appointment (see the post above, referencing Article 2, Section 2, clause 3).

Seriously, trust me - it's not going to happen.

which is why, before I cited Art.2 above, I said "Theoretically possible."

I agree, it ain't happening. At least in a sane world. But we never thought a state legislature would threaten to take a presidential election from the electorate, did we?

I'm afraid Mario is too old, and Andrew is too young (though both men have my respect). I want someone young, with a very limited paper trail...I would LOVE to see a Black or Hispanic justice that would really reflect the values of their community (unlike Clarencce Thomas or Miguel Estrada).

24. I agree that he is one of the most critically brilliant men in America
today. But, remember, Rehnquist was appointed to the court in 1972 (I was 18). He became Chief Justice in 1986 (I was 32). 18 years later he is still making my life, and that of all American progressives, miserable.

Court appointments are the most important power a president is given. Yet, a brilliant justice who only lasts a few years could easily result in a travesty when he/she is replaced with a cheap trick like Clarence Thomas....I'd rather not take the chance.

Make Mario Attorney General-he would be a superstar. Appoint him White House counsel. He'd be brilliant, the most articulate defender any president ever had. Ambassador to the UN? He'd be a joy to watch.

I want a young liberal chief justice, who will outlive me by decades.

11. No fan of Rehnquist, but here's a moment from Clinton's inauguration
Perhaps I was delerious with fever, as I was home sick with flu on inauguration day '93, but something I remember to this day is, after Rehnquist administered the Oath of Office, which Bill affirmed most emphatically, Rehnquist said to him, "My dear boy, I believe that you will!" I remember being very touched by this warm aside Rehnquist offered him. Seems a geological epoch away....

I know this doesn't fit in with the general picture at all, but it did happen; it does not seem to have been duly noted but by me. Same way Al Gore was skewered for sighing during Debate 1, but George Pinhead Bush getting away with honking snot audibly in Debates 1, 2 and 3. (Mr Rove seems to have been successful in training his pet monkey not to honk snot in 2004. Bravo, Mr Rove.)

I watched my father die from cancer a couple of years ago, and it is a horrible thing to see. I just wish Rehnquist would step down from the court.

At the same time Bush is about to be booted out of office by we the people, the Bush-installer-in-chief is going down with him, albeit in a different format.

Poetic Karma?

I swear I'm not trying to be mean. I have no control over karma. If that is indeed what's taking place here, that bastard reeped it himself.

Anyway, prayers to him and his family and all that. Wonder if he ever spent a minute of his time praying for all those who have been injured/killed in Iraq as a result of the man he helped appoint to office.

It's the appointment of the next chief. Rehnquist has been a disaster as chief. This country could not stand another 20 years with assclown Scalia at the helm OR UNKA THOMAS! :shudder:
