We're separated, not divorced.

I'm in a relationship but it's (actually more) open (than I'm comfortable with).

3. Are you sure this is a good idea?
I don't remember if you've posted about your split up or how you've been taking it. This sort of thing has really messed with some people's feelings. You might want to consider your feelings, her feelings, and be sure you are on the same page before you do that.

5. If your relationship...
with your current gf is more open that you are comfortable with, can you talk to her about it? And maybe try and build a stronger relationship with her instead of sleeping with your ex-wife (since that already didn't work)?

ex-wife, therefore, there is no divorce. In our state, if divorce proceedings are pending and the husband and wife sleep together, then the divorce proceedings are no good as the couple resumed their marital intimacy.

(edited because my mind was not working properly.)

11. uummmmmmm . . . that's a legal question . . .
and it requires a lawyer's opinion . . . check w/ your lawyer. I assume you have a lawyer, correct? That is, since you stated you were "separated" but not divorced. The reason why I recommend you ask your own lawyer is that having sex with your wife -- she is still your wife if you were legally married and w/o a court's divorce becoming final -- may have a negative impact upon any divorce or anything else that you or she may be seeking in law about your marriage or ending of marriage.

Again, seek out the legal advice of your own attorney. Got it? Good. BTW, DU or elsewhere on the internet isn't a good place to request legal advice. :eyes:
