back to below Ensenada. Oh brother, okay here's the story. Five years ago we left our home in Punta Banda because of the OUTRAGEOUS drug activity down there.It took us a year almost to find this place. The owners couldn't sell it, so we gave them a down and had an agreement that the monthly payments were going to buy the house. Meanwhile, finally, we rented out the PB place. Which was beautiful after working on it for four years.

We have been steadily working on this place, I mean, we have put ALOT of money into it. ALOT of $$$ and alot of hard work. Yesterday, they sent me an e-mail saying they want the balance within a year.

This is so fucked up, the only way I'm going to be able to come up with a balance is if I sell the PB place. And, nothing is selling down here.Plus, I have people in my house.

Our last project was painting the interior here. So far we've invested about $600.00 towards that.Just two months ago, we had the PB outside painted and that ran over 1K, but we wanted everything nice for the new people. Mike was going to take a week's leave next week so that we could finish the painting before Christmas.We decided, okay, fuck this. He can't return the paint because it was tinted. We decided to just fuck it all and not continue painting.

We have invested so much here, but I know this, when I leave I'm taking the 3 ceiling fans, 2 airconditioners,chandeliers, faucets, replaced water pipes and gas lines, shower heads, towel racks, security door, security lights, doorbell, electrical wiring, linen closet doors Mike made (6 of them), hose outlets, brick on wall, stucco, drywall, graffiti the fucking outside wall I primed and painted, pour crap all over the patio which we sanded down and leveled and painted, graffiti everything I've painted, and pour fucking cement down the fucking toilets. Oh, also the front gate. AND smash the enclosure Mike built for the propane tank, plus all cupboards and shelves he made for the garage. And the screens we put up, and the shades we put up.

If I think of anything else, I'll let you know.

Sorry, but I AM PISSED OFF.

I forgot the roses, and the landscaping, I'm taking that too, before it was just DIRT and I made a beautiful rose garden. Goddamnit.

2. Sorry you are pissed off. Owner financing can be a bitch -- can

you check into getting a loan and buying the place b4 you do all the damage. I've heard raw chicken parts inside the walls behind electrical outlets is not a good thing to do. But seriously, if you have any contract or anything written, take a deep breath, read 'em and see what if any outs you may have. Good luck.

4. Just don't forget that there is a fine line between
removing that which is yours and something that could be called vandalism in court. And its always possible that when you tell them that you can't get the money within the year, they'll reconsider their demand.

6. Now, I may have only taken a High School law class, and
passed it with a D just because I think my teacher wanted me to actually graduate so I could march off to war - but, a verbal contract while not as powerful as a written contract isn't as weak as you'd imagine, and if you have receipts of some other proof of monthly payments made which establishes a pattern, a Judge just might tell the other party to go F themselves in court.

of course major venting (and some real panic) happens when you find out things like this. but im sure there are options to explore as well before the owners have to have the house razed!

I'm truly sorry that you've put so much in and looks like you'll have to move, but why are you so surprised? It's not such a bright idea to put in all that stuff in a place you don't even own, no matter what your expectations were.

Out of curiosity, why do you say the owners couldn't sell it? Is there some kind of legal impediment to selling to Americans?

And before you decide to vandalize this place, think real hard about the karma you'd build up from it. And how you'd feel if your tenants did the same thing.

Next time, buy legally. Or simply rent and put in minimal improvements.

Why exactly do the owners suddenly want the money?

I suppose you've been trying to sell the PB place?

To answer a few questions: No, our house was not located on the spit where all the Americans lost their homes, our house there is located at La Joya, it is not a fideocomiso. Noone is buying down there now because of what happened on the spit.

Yes, there was extreme drug activity, entire surf breaks closed off, and it was extremely dangerous. Remember, my husband is a Fed.

Okay, now as far as Karma goes, fuck it. I have poured thousands and thousands of dollars into this place, and these things are fucking mine. If I go, they go with me. Plus I'm out close to $35,000.00 in down and payments.( And about $7000 in renovation)

We also thought these people were "okay". This is a fideocomiso, and is legal. They are Americans, duh.

I think if any of you poured your heart and soul into a place and were getting screwed, you would feel the same way.

And what's this shit about getting legal advise ? I didn't ask anyone here for legal advise, and I have seen tons of posts from people having personal problems. So, I'm not allowed that luxury ?

Well, fine, fuck you too.

By the way Sheila, expectations were from a written and oral DEAl, not something that I pulled out of the fucking sky. This was a legal deal, they broke it and the chances for fair judgement is pretty fucking SLIGHT, even though we are FM3's. So fuck them. Shame on you for making misjudgements and handing out bullshit advise and information.Do you think I'm that fucking STUPID to renovate a place I was just RENTING??? Nevermind, just forget it Sheila.

It's NOT IF, we infact DID have a "binding'" agreement. You CAN only sign a legal agreement down here if you are an American with FM3 status. There is NO legal system here Sheila, it's who can be paid off for the highest price. I don't have that kind of money.

23. Get a mortgage on the new place?
You've already put a down payment on it, so you should have some equity, right? Mortgage lenders are REALLY hungry right now, so you should be able to get them to bend to help you out.

Maybe you can do the old 80/20 financing... get an appraisal on what it's worth, and offer the current owner 80% of that amount, with what you've paid so far covering the remaining 20%. If he doesn't agree to that, ask him to finance the remaining balance, or just have the bank finance the whole thing... you'll have to pay PMA insurance until you get up to 20% equity, but that's not a big deal.

The owner wants to sell, and doesn't want you to move out, and doesn't want to deal with finding a new buyer. Try working with the owner before you get confrontational and start dragging lawyers into it.

If you're low income, you might even be able to get some assistance on the loan...

Check your Sunday paper's real estate section for mortgage bankers in the area, get an idea of comparables in the neighborhood, and call a few mortgage bankers Monday morning.

In the meantime, see if your current renters on the other place are interested in buying you out. Maybe your mortgage guy can be more aggressive if he can get TWO loans out of the deal.
