Husband prevails before Unemployment Commission.... |

as DUers know, my husband was denied unemployment benefits here in Florida by his former ******* of a boss. He appealed. My husband was 2 minutes late for the hearing on 11/15 because there was a car accident at the entrance to the building. The referee ruled against my husabnd. I called our State Representative who arranged for another hearing the next week. The other side cancelled not once but three more times. Finally last Thursday they had the appeal meeting. It was my husband against 2 attorneys, his boss, and the asst. HR director. My husband submitted a document that is at the heart of the charges against him; that he did not do the entire inventory. The documents stated that no inventory is to be stored anywhere but in the warehouse where my husband worked. It was signed by the managing director. The former boss said he had never seen this document and implied that my husband 'forged'the director's signature. That was the nail in the coffin.
Yesterday, we received a letter from the state saying in essence that the other side should not have denied my husband his benefits. Also, it was implied that he was terminated unjustly. Folks, this is a big win! We can use all this at the arbitration hearing. Plus, we have just learned that we will receive all the back unemployment that was denied my husband. A nice Christmas gift! This takes a big load off of us.

has hired what is considered to be the best labor lawyer in Florida. His name is Rick Sawica and he is absolutely the greatest. Unfortunately, we are starting our second year without a contract.

Glad to hear it turned out in your favor! I have had to deal with the employment commission when laid off before, and it is soooo stressful, especially when asshole employers try to fight what is a just application for unemployment benefits.
Use a little of that back unemployment to have a good Christmas! You deserve it!

to pay for the taxes. Here in Wisconsin, unemployment benefits are treated as income, thus taxable, and if your benefits are paid in a lump sum you might have to pay also.
