Case against motel advances
Friday, January 21, 2005




A child from New Mexico, through his attorney, will try to show in federal court that the Casper Motel 6 neglected to clean his room thoroughly which resulted in his finding and swallowing a used condom and then contracting Hepatitis B, according to federal court records.

Chief U.S. District Judge William Downes has cleared the way for the week-long trial to begin on Feb. 28 after he filed an order that rejected part of a request from Accor North America Inc. -- Motel 6's parent company -- to dismiss the case.

Like many other records in this case, Accor's motion was sealed.

Both the child's attorney Dan Caplis and Accor's attorney Michael Anderson declined to comment on the case.
