Help! I have a pressing question about a distribution from an estate.

Help! I have a pressing question about a distribution from an estate.
I am the executor of my my ex-husband estate. His mother died after he did so his 1/3 share of her estate is payable to his estate. For reasons I won't go into (it's involved) I don't want my ex-husband's estate to receive any partial distributions from his mother's estate at this time.

I found out today that the executor of my mother-in-law's estate plans to make three $10,000 partial distributions, to the two living sons and my ex-husband's estate. I asked that my ex-husband's share be held back to be distributed later. The executor told me that his lawyer said that any distributions had to be made equally each time to all 3 parties.

Is that correct? I don't see why the 2 sons couldn't receive their partial distributions with my ex-husband's share being paid out at a later date.

Please help me out.

3. The "funny" thing is that I have an attorney. Sort of.
She's not returning my calls or email. She didn't close my ex-husband's estate months ago as she could have. I'm going to call another attorney to pick up her paperwork and finish closing his estate on Monday.

I'm not asking for official legal advice here. I was just really looking for anecdotal (sp?) information from people who maybe have been executors facing similar situations.
