concerning a professional photographer's rights....and how much right does an assistant have to the product???

And generally an assistant has no rights to the product--but of course it depends on the amount and type of labor the assistant provided. Still, there would be no assumption that the assistant gets credit to the finished product just because he's an assistant.
Really hard to speculate any more than that without details.

this incident crosses state lines and the photos were obtained under false pretenses I am not looking for credit...I would just like to see the pics....and have copies for my own as these were taken (some of them) on my private property

But having read your posts in the thread, I don't think you've got much of a leg to stand on. If there was no prior agreement to let you see the photos or have copies, it all belongs to the photographer.

was not....he lied about everything....pretending to be personally interested in me, got the pics, went back to Minnesota and then dumped me....now he is saying they are his pics...which I knew I was on shaky ground legally....it is the lack of morals on his part that really PISS me off...come to find out the MF is a repug to boot....:puke: I am just SICK about the whole thing

there is a client or not...I do not think there was a paticular client in mind....unless he would be trying to appraoch HGTV...these are shots of gingerbread house contest and landscpes of surrounding countryside....in a different state from Minnesota...I think he wants to put together a show for next summer

I just don't think the assistant has any rights, but I'm not familiar with US law. The photographer might have the rights on the product if there was no client; otherwise the original photographer holds the right of the 'negatives', which came obsolete with digital imaging.
I'd suggest you contact the photographer.

a lawyer, and it might be totally different where I live. But if a photographer comes and takes picture of our house, these pictures are mine, no matter what, since it's private property. I don't think that's what you're asking though.

some were taken on MY property and some were taken of the surrounding countryside. They were taken with a digital camera...does that make a difference

that you want to have the ones that were taken on your property? If you did not give the photographer permission to do so, these pictures are yours. Even the ones showing just an inch of your property.
