Near maximum sentences in Wendy's finger caseMercury NewsAnna Ayala was sentenced this morning to nine years in prison and her husband to 12 years, four months behind bars for a scheme to defraud Wendy's by planting a human finger tip in a bowl of chili.

Santa Clara County Judge Edward Davila announced his sentence in San Jose's Hall of Justice. Ayala was facing a maximum of nine years, eight months in prison. Her husband, Jaime Plascencia, could have received up to 13 years for his role in the scam and other crimes.

Plascencia, 43, and Ayala, 39, concocted a scheme to defraud Wendy's. On March 22, she placed a finger tip into her chili and caused a commotion at the fast food chain's restaurant on Monterey Highway in South San Jose. The case was soon known across the globe.

8. Sorry, I think that's too much
when you consider that they didn't inflict physical injury on someone. It doesn't make sense that she or her husband should have to serve more time than many child molesters.

10. That simply means that the child molester should get more, not that some
scumbag who tried to defraud not just Wendy's but the entire nation via publicity, etc. should get less.

But I guess this is a lesson for us all. It's a much more serious offense to attempt to defraud a big business than it is to commit a crime against another person.

that whole "time off for good behavior" crap means she won't serve anywhere near 9 years. Watch them put here to work in the cafeteria, serving prison gruel. How about some punishment for the guy who sold her the finger, knowing what she was planning to do with it?

Typically, with good behavior they will be paroled after 3 years...

Probably why they got such a harsh sentence to be sure they spent at least sometime behind bars

Wendy's representatives estimate the restaurant has lost more than $21 million overall as a result of the crime. The San Jose franchise owners claimed losses of almost $500,000.

Ayala and Plascencia were ordered to pay those amounts in restitution, but Wendy's and Joseph Desmond, the owner of the Monterey Highway Wendy's and seven others in San Jose, said they will not seek to collect the money. Ayala and Plascencia will be held responsible for about $170,000 in restitution to employees of Wendy's for lost wages.

In addition to the felony counts in the chili case, Ayala had also pleaded guilty to an unrelated charge of defrauding a San Jose woman in a mobile home sale. Plascencia also pleaded guilty for failing to pay child support, child abandonment, identity theft and fraudulent use of official documents.

But if it was an accident, why should they? Did anyone go to jail for the E. coli outbreak caused by Jack in the Box in 1993?
