the Divorce Judge will issue a QDRO which stipulates that I have to give half of my 401(k) balance to my wife...and that QDRO is authorization for the money to come out of my plan and move into her own qualified account, and no taxes or penalties are due now.

It's an IRS thing. I didn't do this kind of thing but I remember seeing the term in many publications.
