3. no.. fair use allows me to use any music
and the animation will most likely be a sad one, but i'm also up to doing a more inspiring and upbeat one.... so any type of music.

You probably ought to talk to an attorney about the copyright issue; it should only take a very short consultation at little to no cost to get advice about this. The usage and the percentage of copyrighted works used (i.e. more than a fragment) seem well beyond the scope of "fair use" in the works of yours I have seen. There are several different types of copyrights involving music (SR-Sound Recording, E & RE - words & music, PA - Performance), but the one you would be interested in would be for "Sound Recording", prefixed "SR" at the US Gov Copyright Office registrations. The holder of most SR copyrights (for almost all well known works) is generally a record label, as opposed to the artist or authors of the words & music. In SR copyright registrations the name of the artist or group appears in the copyright registration but is actually the description of the copyrighted SR, not an indication of the copyright holder’s name. In general, if you can buy it in a record store or Amazon, it has an SR copyright owned by a record label. Sooner or later as your work becomes more well known you're likely to trip over this issue.

Also, although there are many knowledgeable people on this board, you should make sure whomever you are accepting advice from is actually rendering a qualified expert opinion. In other words, talk to an attorney.

35. Ohhhh...that's a good one too.
He was supposed to be my college commencement speaker, so I took another semester so I wouldn't graduate, just to not have to listen to him gloat and pontificate for 40 minutes.

It was moot anyways as I had threatened in the school newspaper to "pie" him (banana tofu "creme") mid-address and was banned from attending graduation. :evilfrown:
