I have an appointment for a job that is temp to hire through an agency in the morning. I am beginning to wonder if it is the company that I have been trying to get an interview with. They have my resume and several friends that work there have been bugging the HR guy (who is notoriously slow to get around to doing anything and says I will be the first one he calls) to call me in for an interview. If I find out that it is indeed the same company, what is my legal position? Can I be a direct hire for the company if they already have my resume? I am thinking maybe I need to ask if it is that company before I sign anything.

Had asked me which companies I have recently submitted a resume to. They don't want to submit a resume to a place that you have already submitted one to. Even if they don't ask this automatically, make it clear that you have already applied to company XYZ and don't want your resume submitted there. You can also request that they don't submit your resume for any position at any company without first notifying you (most agencies have this policy anyway). You might want to make sure though that your prospective company does do direct hire. Some companies hire exclusively through agencies, especially for some positions.

I will ask about the direct hire thing. I haven't done an agency thing in many years...
