So, today is my Crim Law final. |

It's not gonna be as scary as Contracts was...I've got my cheat sheets and my book's tabbed (it's limited open book/note) and since it's short answer, not multiple choice (and especially, not "two of the above"), I'll have a better idea of how the exam went when I leave.
(Strategy: Blaze through the questions with quick easy answers -- and there will be some -- then go back for the longer questions and slow the hell down. Trying to get done too quickly WILL mess me up on this one.)
Then, onward to Torts Tuesday, then...done!

When I took Criminal Procedure (in 1977), the things the prof pounded into our heads were that you HAD to have probable cause for a search, you HAD to get a warrant, and you HAD to pay attention to the Fourth, Fifth and Sixth Amendments. Now -- not so much.
Interesting times, indeed.

And my instructor has somehow succeeded in making rape and murder boring. (Not that he should be glorifying it, but you know what I mean.)
I might take criminal process later, depending on the instructor.
This exam's on homicide, inchoate crimes and defenses. We had a theft unit but that was covered in a separate paper.

A common law crime. Must be at night, with the intent permanently to deprive the owner of their property. Or something like that. Yeah, that was dull -- procedure was much more interesting.

5. The model penal code (which in this case borrows from common law) is terrible on rape. |

A man can't be raped. A woman can't be a rapist. A wife can't be raped by her husband.
It's not the law of the land in most jurisdictions.
