NH man keeps drinking, while being arrested for DUI, *FOURTH* time!
And just listen to what he said while being busted.

What the hell can we do with hopeless cases like this? :grr:

Police: Man Drinks Beer During Arrest

MANCHESTER, N.H. -- Manchester police said they nabbed a man who was caught driving while intoxicated for the fourth time.

Police said they tried pulling over Patrick Allain, 35, on Bridge Street on Monday night but he refused to stop. Officials said that when police finally did stop Allain, they found him drinking a 40-ounce bottle of beer, which he continued to drink as officers confronted him.

As officers arrested him, two other drivers told police that Allain had hit them and not stopped, police said.

Police said that when he was booked, Allain told officers, "You can charge me with whatever you want. It's not going to stop me from drinking and driving."

5. He is almost certainly a serious alcoholic
I realize that that doesn't absolve him in any way. He should receive a serious prison sentence. However, unless society is prepared to lock him up for life, he will probably do it again without treatment. He needs treatment.

11. Is there a treatment for a sociopathic personality?
Look, the guy COULD possibly be cured of his alcoholism, however, apparently he simply doesn't give a fuck about human life in general, so, is there a cure for that?

I'm not a doctor. I just speaking generally about people who get multiple DUIs. In my opinion, jail is deserved, but unless they're locked up for life, we better do something about the root problem. In some cases, there may be more than one problem.

6. I have heard this can actually be a defense against a DUI, because it
cannot be proven the person was legally drunk while driving, but his BAC got elevated AFTER the stop. Anybody else know about this "unique" defense?

9. I don't see how that would work...
Unless the guy took a few shots of Everclear right after being pulled over. Most beers, a gulp or two will NOT dramatically increase your blood alcohol level, at least right off the bat. Also, they do 2 tests, usually, one "on scene" and another at the station that's more accurate. The beverage in question also will get tested for alcohol content in cases like this, to see if it was possible to increase the blood alcohol level, usually this disproves the defense.

Also, DUI/DWI are defined differently from state to state, generally, you have to be in the driver's seat of a RUNNING CAR, not necessarily DRIVING, but also on a public road. So a guy pulling over by a cop, with the engine running, drinking a beer, has no defense. Other states restrict it to when the vehicle is moving, or a combination of the two.

14. That's just the point of drinking dramatically in front of the police. If
your blood alcohol goes Down in the subsequent test later, that means you were drunk at the stop. If your BAC goes UP at the later test that means they cannot prove you were drunk at the time; rather you got drunk AFTER the stop.

A drunk without a car is not very dangerous, but somebody with a car, drunk or sober, is a problem.

10. Isn't there a way to forbid him from owning a car?
Cars have to be registered, and taxes paid on them, couldn't his finances be "red flagged" so that no dealer can sell a car to him?

And off he goes. There are ways around everything. The idiot needs to be in jail before he kills someone.

15. You obviously don't live in a rural area.
Or at least in MY rural area. It's as easy to get a car as a gun - no dealer needed and if somebody doesn't care about driving drunk why whould he care about being legal?
