Woman Sues After Slipping On Vomit At Wal-Mart

First came a puddle of vomit and a fall, then a classified advertisement and now a lawsuit against Wal-Mart.

June and James Medema of Blue Grass, Iowa, filed the suit May 22 in Scott County District Court, alleging that negligence led to June Medema suffering severe personal and permanent injuries in a June 13, 2005, fall at the Wal-Mart SuperCenter on West Kimberly Road in Davenport. The couple is asking for at least $5,000 in damages, according to the suit.

The suit does not make any specific allegations stating how the store was negligent in the incident.

John Simley, a spokesman for Wal-Mart, declined comment Tuesday.

“We haven’t seen the suit and we can’t comment on something we haven’t seen,” he said.

In mid-March, the Medemas’ attorney, Michael K. Bush of Davenport, ran a Quad-City Times classified advertisement looking for witnesses to the incident. At the time, he thought two other people also had slipped and fallen because of the puddle, but he received no responses to the advertisement.

June Medema suffered serious neck and upper back injuries from the fall, has undergone a number of surgeries and is disabled from work, Bush said in March.

Bush was unavailable for comment Tuesday.

2. I turned the corner at WM one day with my 1 yr old son in my arms
and slipped on a puddle of alcohol. My feet went right out from under me and we both went down. I hit the hard floor with my elbow and my son never even touched the floor. I immediately had three women around me trying to help me up. The store manager had me fill out an accident report. Junk lawsuits just cost everybody in the long run. Real personal injury is something else but I would bet that most cases are people out for a quick dollar.

4. Well, it sounds to me as though she really got hurt.
When my aunt slipped and fell in Macy's many years ago, a guy ran over and said "Stay down, lady, I'll get a lawyer".

my father tripped on a shelf that was disconnected from the frame and hanging out into the aisle. He broke his wrist trying to catch himself.

He didn't have to sue, he just asked the store mgr/district mgr for lost wages while he couldn't work (he was a truck driver), but they threw in 5,000 for pain/suffering just to be nice.

I guess there are instances where stores do the right thing.

9. This might be a bit off-point...
but why wait until 23 months after the incident to file a lawsuit? That reeks of a lack of credibility.

11. I once slipped on some water in a hospital corridor when I was visiting my father there.
The hospital workers all came over, made me get in a wheelchair and go to the emergency room, etc. (Turned out I twisted my ankle badly and couldn't stand on it.) I never got a single bill for any of the treatment; I knew they were scared that I'd sue them.
