The mother of a boy who wandered onto I-465 on Indianapolis' Northwestside pleaded guilty to three counts of child neglect this morning in Marion Superior Court.
Nancy Dyer, 31, faces a maximum of two years in prison under a plea agreement reached with prosecutors as her trial was scheduled to begin. She had faced five low-level felony neglect counts, and prosecutors will dismiss two of those.
Dyer, who is pregnant, could avoid prison. The sentence will be up to Judge Lisa Borges, who set a sentencing hearing for Aug. 20. The plea deal caps the non-suspended sentence at two years in prison or a community corrections program.
Motorists found Damon Stewart running on the freeway Dec. 30 near Scarborough Lakes apartments, where the family had just moved. Some of the charges were related to conditions in the apartment. Dyer pleaded guilty to counts involving the freeway incident, another episode in which Damon wandered around the apartment complex and her 2-year-old daughter eating spaghetti off the floor.
