The last surviving parent passes away and leaves a will to five children.

The will noted several (no interest) loans against the estate.

Amy had borrowed $15,000
Brad had borrowed $10,000
Craig had borrowed $7,500
David and Emily had no debts to the estate.

The estate is worth $95,000.

How much should everyone get?

The estate is $95K. What do we do with the other 32,500?

Not run off into the hills with. They still owe the estate, the remainder of which is $95K.

So how best to fairly settle all debts and distribute the estate at the same time?

and add it to the numbers above, you get the same answer you came up with at the end.

so either way you figure it, the #'s are the same.

But that is with the loans missing from it.

So it is actually worth $127,500.

Each person gets $25,500, but the borrowers are less the amount they've taken out prior to the death.

So Amy gets $10,500
Brad gets $15,500
Craig gets $18,000
and David and Emily get the full $25,500.


How's that?

We have an answer.

And that's the one I ran with. And I haven't been sued by any of my siblings. I was so stunned and grief stricken at the time it was like I was sleepwalking. I couldn't figure out the simplest calculation.

But that is the exact answer I came up with, with the same logic.

15. Although, debts to the estate are part of the estate.
So, the estate could be consideres $62,500 plus $32,500 as collectible debt.
