I'm so mad I want to scream!!! |
|
I'm on my bicycle, going down a city street.
Some (really horrible expletive deleted) runs a stop sign in a HUGE frikkin' SUV, and to keep from being smeared by the jerk, I swerve, hit some ice, and fall into a ditch.
The MF'er in the SUV gets out, looks at me, and drives off.
I got his liscense number, and 3 witnesses at a bus stop saw it.
So i have a bruised left hand, (it feels like it was broken,) and I was at the ER, and my bike is ok though.
The guy was talked to by the cops, they are nailing him for running a stop sign, leaving the scene of an accident and drunk driving. His THIRD offence!!!
And I'm gong to sue that MF'er so bad he'll need to sell that monstrosity he drives to make up for his teeny dick, just to pay me.
BTW, his bumper had right-wing bumper stickers all over it.
(Bleep)-ing Freeper trash!
Sorry about the rant, just so angry here.

These self deluded bastards think they own the world and so much for anyone else. Simply shameless. And they are always some kind of fanatical 'Christians' living in ultimate hypocrisy.

4. it's tough being a biker in the winter around here |
|
I keep an extra special eye out around Minneapolis. The bikers can't stop any better than the cars can, and the snowdrifts force them farther out into the lane.
Glad you're all right. Buy his SUV at auction and drive it past his house once day. Whadda jerk.

Every day I walk to my office from where I park my car. I can't tell you how many times I have been almost run over in a crosswalk because someone is too busy talking on a cellphone or in such a hurry.

9. Make sure you get an MRI for your hand: |
|
Not only are they much better at finding possible damage to soft tissue, but they cost a fortune. Make sure this d***head pays for it. Also recommend you see an Orthopedic specialist.

11. Archae get a good lawyer who is also a BIKE advocate |
|
it will make all the difference in the world. You may want to consult a bike advocacy group for bike friendly lawyers. The SUV driver will want to paint you as a wild eyed radical deserving of your treatment.
Here is St Louis it's like it's fair game on bicyclists. Rare is a conviction.

15. Just be angry for the right reasons |
|
Hating this person because he appears to be everything you are against is really not a great reason to sue. It is almost always a mistake to prejudge someone, then make a business decision based on that. As an attorney, judging solely from the facts you have presented, my view is that you will have a difficult time winning a judgment against this person, particularly if your bike was not physically struck. My advice would be apply heat on your bruised hand twice and day, rein in your anger over some predispositions you may have about this person ...and get on with your life.

18. Document, document, document! Pictures, affidavits or at least |
|
Edited on Thu Feb-05-04 08:58 PM by hlthe2b
statements from the witnesses (the police may NOT have gotten their full statement, so don't assume) and your extent of injuries. While, given his history it sounds like a slam dunk, you just never know. But witnesses often drop out when it comes to going to court (or forget details), so definitely try to get their signed and witnessed statements asap.
On edit, I just realized you swerved to avoid him hitting you and (quite fortunately) his big vehicle did not hit you. All the more important that your witnesses are able to verify that he forced you off the road where you lost control. Otherwise, my guess is that he'd squeak out of any damages to you.
Glad you are ok, Arch...

40. You MUST get his auto liability insurance company's name. |
|
They are the ones that are going to have to defend him and it DOESN'T matter if he did not come into physical contact with you. He is still liable. If you drive, call your insurance agent and get him on it as well. I know you were on your bike but a pro will help you.

Maybe we should explore the ide of progressive fines for traffic offenses.

20. I just got a call from the SOB! |
|
He's sitting in the drunk tank at the Sheboygan cop shop, so he takes his one call, calls me.
He is obviously still drunk off his ass.
He says the whole thing is all MY fault.
Says he's going to kick my ass, find me, kill me, and my family. I hung up.
I called the cop shop back, telling them what had just happened. So now they are adding MORE charges to this Freeper-type's rap sheet.
BTW, before I hung up, I told him I own a handgun. (I do.) So if he does show up here, I will show him the gun.

His insurance co. will always low-ball the first offer. Stick it to 'em. I am not in favor of frivolous lawsuits but this is not one of those. You have specific rights. If you have any questions contact your state Insurance Dept. and I have no doubt that they will be very helpful.

Nearly hit you with his Entitlementmobile, and then made a threatening phone call to you from jail?! Multiple DUI convictions?! Yow.
I despise these folks who drive around with their colossal senses of entitlement -- woe betide anyone who gets in their way, even inadvertently. I'm totally unsurprised to hear that he thinks it's all YOUR fault. The main symptoms of a hyperinflated sense of entitlement are a total inability to take responsibility for one's own actions, a lack of empathy, and a tendency to blame others...
