I bought an ebay item in June and still haven't gotten it. |
|
20 emails, multiple complaints to ebay, nothing. I haven't received my item. I lost 20 dollars. He left a positive feedback for me but never sent the item. Anybody have any ideas on what I should do???

1. I want to know as well! |

There are some laws in effect, but they depend on the state that you live in.

I can't believe it's that hard just to send an item to someone. He had a lot of positive feedback so I thought it would be fine. He sent me an email in August 03 that he'd send me another shirt but after that he stopped responding. Total jerk.

had a buyer protection service...I believe they automatically insure purchases up to $300
Try searching through the "site map" for the right area...I recommend you find the user forums and post a message on there describing the situation. They should help you out in getting your refund.

4. Write your state Attorney General |
|
that's the state officer that is usually in charge of problems with businesses.

7. Have you contacted him? |
|
Try dealing with him directly, then through Ebay's "Safe Harbor" system.
If you think you've been ripped off, you can file a claim of mail fraud through the postal service. Mailfraud is a federal crime if it occurs between two states, and it is taken very seriously. I once had to point out to an Ebay seller that he could be investigated for breaking a federal law for defaulting on a transaction with me, and he hopped to it and resolved the situation right away.

8. Did that Safe Harbor thing too |
|
Nothing!!! I have sent him emails telling him I'd take it as far as I could but nothing. And he's been active in selling and buying, so I don't know.

9. At least leave negative feedback |
|
Sellers need a good reputation in order to keep doing business on ebay. You've given this guy every chance to make good on the transaction, so you should not feel guilty one bit for leaving the most blistering feedback you can. It may not get you your item or a refund, but maybe someone else will think twice before dealing with him.

10. It's probably too late for that.. |
|
I think there's only a limited time in which one can leave feedback following a transaction. 30 or 90 days, I beleve.

12. Did you pay for shipping and was it to be shipped by USPS. |
|
If part of the money you sent him was for shipping by USPS you may be able to file a complaint for mail fraud with the USPS. My son did this on a $20 transaction and the Postal Service sent the guy a nasty letter and he got his $ back.
I'm a paralegal and I will tell you to forget any legal action unless you happen to live in the same state and area as he does. You can't get jurisdiction over the guy.
I would leave him a negative feedback but before you do that you might want to check with the people at the ebay community. Click on community and you will find the reference.

13. So I'm not the only one! |
|
I know it's small consolation, LPFF, but I got ripped off on eBay too. Not as long ago, but it was for more money ($140). I'd thought it would be okay since he was with a group I already knew ... and besides the military re-enactment community is relatively small, so news of frauds tends to spread quickly. (Plus, the victim and his/her friends are armed with lots of sharp, pointy objects.) However, I now have evidence that he was receiving the cash under an assumed name.
Is there any way somebody at eBay could be appealed to, in order to allow you to leave appropriate feedback? (I'm in the same boat on this one, since the 90 days have already elapsed.)

14. I had a similar problem, only the other way around |
|
I waited and waited and waited and waited and waited and waited for money to come from a buyer. Finally I grew tired of having the package in my car, and one afternoon while I was at the post office I just sent the stupid thing.
Still waiting. Whatever.
