Taylor also ordered Johnson to make restitution of $7,407 to the city. The payments, Taylor said, must start two months after Johnson is released from jail -- and must be for at least $100 per month.

If Johnson fails to keep up with his monthly payments, he will have to serve the full term of his sentence, Taylor warned.

"You'll have the nine years and six months hanging over your head," Taylor said. "And you don't want that."

Authorities set the $7,407 figure after determining that Johnson stole 15,760 bricks from a sidewalk adjoining the Shockoe Hill Cemetery.

Authorities said during a six-week period, Johnson would drive to the cemetery just north of the interchange of Interstates 95 and 64, dig up the bricks from a sidewalk, load them into his van and sell them for 50 cents apiece.

He was arrested in January after a Richmond police officer observed him putting bricks into his van.

Even though Johnson sold the bricks for 50 cents, city officials said it cost much more to replace them. The bill to repair the sidewalk came to about $37,000, authorities said.

Those buried at the cemetery include U.S. Supreme Court Justice John Marshall and William Foushee, Richmond's first mayor
