While science may classify the tomato as a fruit, the way a tomato is used in cooking it would be considered a vegetable.
Keep in mind that if you scientifically classify a tomato as a fruit you must also classify cucumbers, squash, green beans and walnuts as fruits by the same science.

Fruits have seeds; vegetables do not. Cucumbers, avocados, tomatoes, even zucchini are fruits, but all are eaten as if they were vegetables because they are not sweet.
Let me coin a new portmanteau word for fruits eaten as vegetables: fregetables.
So, now, a tomato is a fregetable.
