Teacher Dumped After Stern Appearance Sues
Claims school improperly forced her out after racy radio segment



JUNE 27--Meet Marie Jarry (and her husband Aaron). The Connecticut woman claims she was forced from her job as a second grade teacher after appearing in a bikini on Howard Stern's radio program. And now she wants her job back, according to a lawsuit filed Wednesday in U.S. District Court in New Haven. In May, the Jarrys participated in a "Hottest Wife, Ugliest Husband" contest on Stern's show, and walked away with the $5000 first prize (the below photo of the couple was snapped in Stern's Manhattan studio). Jarry, 28, took a sick day from her job with the Thalberg School to attend the Stern broadcast, which she now admits wasn't such a good idea. Upon returning to work, Jarry was told that she had violated a school "morality clause" and was going to be fired by the school district's superintendent, according to her complaint, a copy of which you'll find here. Jarry also recalled being told she could be arrested for defrauding a governmental agency for taking a bogus sick day. Jarry claims that school brass "intimidated and coerced" her into resigning her teaching post "in lieu of termination." Jarry, who began working in the district in 2003, charges that school officials denied her due process and engaged in sex discrimination. In addition to unspecified monetary damages, Jarry's lawsuit seeks back pay, reinstatement, and attorney fees.

She's an atheist in a small, very conservative school district. Other teachers witness to her, invite her to various churches, ask her if she's saved. She's actually afraid to be seen purchasing beer in town. When someone installed a statue of the FSM on the courthouse lawn, she wanted a picture of it, so she put on some sunglasses, pulled a hat down low over her face, eased up next to it in a car, and looked around to make sure the coast was clear before snapping a shot.

I sometimes joke with her that the story in the next day's paper will be 'Local teacher fired for drinking beer,' with a surveillance photo of her at the cash register.

12. I'm an atheist teacher in a liberal, supportive school,
And I STILL don't feel comfortable sharing my convictions. When some students of mine noticed that I was an atheist from my Facebook profile, I quickly changed it.

14. Teachers have to be so bland
It's almost as though you can't have a public personality. Every little thing can redound against you, and your worldview can only get you into trouble. I don't know how you all put up with it. It's like a straightjacket in some places.

So long as a teacher isn't fucking one of his/her students, making off with class-materials money, killing people, or abusing animals, what they do on their own time is their own damned business, as far as I'm concerned. Unfortunately, since school administrations generally act as a magnet for meddling, petty jackasses, we're going to keep on seeing this kind of shit.

She took paid (presumably) sick leave to go on a radio show and make $5k.

And, for the record, she looks all right to me. But yeah, not so bright.

15. Yeah, if she hadn't used a sick day, she might have a case.
I think morality clauses like that are bullshit. What you do on your own time is your own business. But, she called in sick when she wasn't. I feel bad for her, because who among us hasn't used a sick day when we weren't sick at some point? It's a spectacular way to get caught, and probably not the brightest move to begin with.

30. Most teachers (and I'm one)
use sick days to do other things. She should demand that all the teachers account for their sick days. I know guys that go fishing, to nascar races, females that will take a sick day just because they need a break. I bet a whole lot of teachers that used sick days in that school weren't really sick.

That's the issue, not "morality".

She should be fired for being stupid, as she could have taken a personal day (I'd wager her school gives at least 2 to teachers, as mine does).

27. exactly why I don't want to have anything to do with the school system
I am one credit away from a MA in US History and I'll probably end up NOT teaching anywhere (except maybe at community college).

I'm also an out lesbian in a committed relationship who drinks, curses, watches porn, and I have a pretty good collection of lesbian fiction in my possession. There's no way I could survive as a public school teacher.

28. That is a good example of the mindset...
... that makes the teachers I work with the most boring, bland, banal, and soul-less group of people I have ever met. I spend the vast majority of my free time holed up in my classroom because I have no interest in associating with any of them.

They are the kind of people that would throw a fit that someone was spotted in town with a beer in their hand at a restaurant, or went out in a bikini. This woman shouldn't have used a sick-day, but there is not reason to believe that she is "immoral" because she went on Howard Stern in a bikini.

33. Why are "morality clauses" still legal? What somebody does on his or her own time is that person's
business. However, I don't like that she took a fraudulent sick day. I could understand the school disciplining her for that. But I've never liked the idea of employers telling their employees what they can and can't do when they are not working.
