Best question about probate ever! |
|
I was perusing WikiAnswers one day (I've been promoted to Supervisor of the Volkswagen and Honda groups...) and came across a question by a woman who was serving as executrix of her husband's estate. From what I gather, the husband didn't put in his will that he waived bonding of the executrix--probably because he didn't realize he had to--so whoever in the state government that deals with probate told her, naturally, that she had to be bonded by an insurance company.
The question, posted exactly as she spelled it (when you write questions you can't start out in the first person--you have to say "your engine fell out on the freeway, how do you put it back in" rather than "my engine fell out" and you can't use punctuation), is as follows:
Your husband died why do I have to be boned by an insurance company?
Before I answered it (informing her that the heirs can band together and state they trust the executrix, and therefore they waive bonding), I was kind and added the "d" to the offending word.
The real answer, of course, is that boning claimants is what insurance companies are there for...but after the woman lost her husband I couldn't tell her that.

It's also a shame that the widow has to jump through this hoop.

5. Legal Jargon is Funny Sometimes |
|
I work in legal and the other day I did a Last Will for a couple and the husband called me and said, "what the hell is issue and why am I leaving all my stuff to it when I have a wife and kids". I had to explain it. And I still can't stop laughing at penal code and don't even get me started with the latin phrases.

Sole and Independent Executor (Executrix) and I direct that no bond or other form of security ever be required of (either of, any of) them.
