Apparently one CAN be denied coverage during open enrollment |
|
They see "herniated disc" and BAM - automatic denial. Am I supposed to LIE?
Guess it's COBRA for me. Can I be denied coverage under that???

1. Did you have a lapse in coverage? |
|
If you didn't have more than a 63(?) day lapse, and you were covered for the year preceding that, the federal HIPAA law says you can't be denied due to a pre-existing condition, and there would be no waiting period to get treatment.
Also, even if you don't qualify, I would think they would have to let you get the insurance anyway, and then wait for 12-18 months till the pre-existing would be covered.
