Anyone here who might be willing to weigh in on a situation I'm in? |
|
Edited on Tue Feb-24-09 05:50 PM by lady raven
I'm having some legal trouble, all caused by a neighbor who has been harassing me since 9-2007. Her latest stunt appears to have put me at risk for arrest. I was hoping someone here who is a lawyer or cop wouldn't mind letting me send them my personal log of the situation and tell me what they think.
I have put a call in to an attorney who used to be a neighbor of mine, but he's out til next week. I don't want any heavy legal advice, just someone to listen and tell me if I'm in the wrong or not.
Thanks...
edited to remove cops/ lawyers. I just hope for some normal people who don't happen to be "good old boy small town cops" to weigh in on what they think.

1. As a cop im telling you not to do this |
|
chances are the laws were you live are totally different to were i work, so the advice would be sketchy, and you might sour any legal proceedings you have in the future. Plus if your neighbour comes over and chops you into small slices then i am in the shitter as well.

6. OK, but I'm not sure that jurisdiction will matter quite so much. |
|
I'm just at a loss right now. I have been a nervous wreck, crying all day.
This woman filed a complaint with animal control stating that my dog was barking all day and all night (He is in the house all night and does NOT bark constantly) and I am being told that, based ONLY on her complaint, even though she has NO proof, they are going to issue a warrant for my arrest. I'm scared to death.
She has been harassing me using the legal system, Child protective services, the postal inspector, and even my own mother to harass.
I guess I was just hoping someone would read my story and tell me if they think it's fucked up or if I'm just crazy.
I do thank you for responding though.

I"m going to post my whole story from my personal notes in a moment. Nobody has to read it, but I'll post it. It's going to sound crazy in a sense no matter what because it was written at an emotional time and was meant to be for my own personal use. But it covers absolutely everything.

With the condition her crap has put me in, if she were to come and chop me into small slices, I think I'd be better off. I'm losing sleep, having heart palpitations, and today I had a panic attack. Being sliced to bits would be almost preferable.
She's a 70 something year old lady. It would make the news! I'd be famous.

2. The odds of someone giving you a good answer are quite slim |
|
They'd need to know all about local laws and whether or not you're in the wrong is frequently irrelevant when legal proceedings are involved

9. Well, what I'm being accused of is completely false and never happened, so I can't |
|
see how I would be in the wrong, but the cops sure seem to think so.

8. OK, would someone who is NOT a cop or NOT a lawyer read my story as a regular person |
|
and tell me your opinion? I have been treated by law enforcement like I am some kind of crazy criminal.
I can promise that there is NOTHING missing from my story. There is no "there must be more to this". I feel VERY alone and like everyone I come in contact with thinks I'm a criminal or a nutcase.
Frankly, I think at this point that I AM turning into a nutcase. This woman has put me in fear of answering my door. I broke down crying yesterday after UPS rang the doorbell because I answered expecting to be taken away in handcuffs and it was just someone delivering my husband's CPAP supplies.

19. Hopefully my old neighbor will cut me a break. If not, I'm SOL. |
|
I had to borrow money for diapers this week. The bond will be $500 and the fine about $1k. A lawyer would cost me more than both combined.

I'm going to jail because a neighbor lied and said that my dog is barking. I don't know that it could get any worse than that.

See if there's some kind of service in your town that can provide assistance. That's the first thing, IMO.

I've been gone all evening taking my dog to his (hopefully not permanent) new home. I absolutely hate this.
Now that she won't be able to harass me over the dog anymore, she's going to move on to something else and our family will be minus a loved member.
I hope that at least this will result in her getting caught. As much as I hate it, I hope she makes some more false reports. Now that we can prove the dog isn't at this address at all.
She was lying before and I know it. The cops and animal control frankly don't care if she is telling the truth or not. They're going to go after me either way. But I don't see much way around it if the dog doesn't live here at all.
