I know exactly where this happened.

That is a busy intersection even when there isn't any work going on underground to snarl everything into a mess. She is a damned fool to be walking in the street and not watching where she is going, especially there.

Yes, the whole should have been blocked off with cones and rails. That's Standard whenever they have a manhole open. But she should not be walking in the street without watching where she is going.

If this goes to court I think the best outcome is for the judge to find that they share responsibility. DEP's responsibility amounts to an order to enforce safety proceedures, and $0 in damages. Her responsibility amounts getting her ER medical bill covered and getting no damages.

That, I think, would be fair.
