need some lawyerly type help |
|
ok here's the situation...we have a community well up here for three houses....we have a signed notarized agreement on file at the courthouse that the people whose property the pump is on will provide water for one third of the maintenance cost of the well.
They cut our water off today because they are mad at us.
Besides filing tomorrow to get the water turned back on can I file on them for harassment and inconvenience in small claims court?

1. Depends on what your local small claims court has jurisdiction over. |
|
Most small claims courts handle only claims for established damages (e.g., unpaid bills) based on contract law, not tort claims, which would include harassment. You'd have to talk to a lawyer in your area.

3. That might be worth a try. |
|
Payment of attorneys' fees would depend on the rules of your small claims court.
