Jon Gosselin Goes After Kate in Court

Jon Gosselin thinks "Dancing with the Stars" is damaging his kids, thanks to Kate Gosselin ... and Jon now wants primary custody as well as spousal support from his ex ... TMZ has learned.

Jon's new lawyer, former assistant U.S. Attorney Anthony F. List, tells TMZ he's going to court to ask for primary physical custody. List calls Kate, "an absentee mom," which he says is no surprise to anyone.

List expects to use "DWTS" as evidence that Kate does not spend "quality time with the 8 kids."

List also thinks Jon is getting screwed in the child support department, claiming "$20,000 a month is ridiculous."

In addition to primary custody, List says he's considering asking the judge to reverse the support obligation and make Kate pay Jon. He did not specify the amount.

Kate tells TMZ, "I am and always will be a mother first, but as a single working mom I will do everything necessary to provide for my kids despite the opinions of others."

1. Let's see - "Dancing with the Stars" films in Los Angeles, 3000 miles from her kids

PLUS the woman is starting a book tour soon. Book tour again means she won't be home with the kids which all of those kids are of school age. Someone has to be at the house to raise them.

If John is the Human Cockroach, Kate is the Human Termite - both gross, destructive and unwanted by most humans.

Personally I think all those kids should be put in a home where they can have at least one parent who will be there on a regular basis.

Thing is, if they never got themselves on TV - this family might have lived a normal life.

2. Agreed, absolutely...
...moving the kids (and the money) from Kate to Jon will benefit one person...Jon...who hasn't been getting "D.W.T.S." money like Kate.

And doing book tours and reality shows is not it.

I realize that it will be tough to find a job in Central PA that will help pay for the home and raise the kids. If these 2 idiots were smart enough they'd try to find a solution that kept at least one parent in the house at all time while the other was out raising the child.

I worked with a divorced couple that had a similiar type living arrangements. The husband didn't really have a home large enough to bring the 3 kids to stay with him for the weekends (and she wasn't too keen on the woman he was living with - the reason she filed for divorce in the first place). So the agreement was that when he had the children, he would stay at the main house (girlfriend was not invited at the time) and she would stay with her parents. Usually he had the kids on weekends and a few full weeks during the summer. But the thing is - the kids were not disrupted from their lives and at all times the children would have one parent living with them and spending quality time.

I understand she doesn't want to be around him and honestly, I can't blame him not wanting to be around her. But they should set up a living arrangement where he can be with the kids (leave the girlfriends elsewhere) while she trollops around the country trying to raise money and grasp on to the remaining seconds left of her 15 minutes.

I didn't watch the show except a few episodes that were playing when I was visiting family over the holidays (also from Central PA). And honestly, she deserves what she got. The way she belittled him and verbally abused him - she was a horrible woman. I've read where she's not getting along very well with her dancing partner either. Seems she has some serious insecurity issues she needs to deal with.

And I can't see why anyone would buy a book from her. Not exactly like she's a role model for good parenting.

7. Hmmm
There are a lot of dads with jobs that require traveling. I think there might be some sexism embedded in the idea of what "acting like a mom" is.

I'm not saying she's a good mom, mind you - I don't think she has much in the way of parenting/people skills. I just don't like the notion of "acting like a mom" vs "acting like a parent."

4. I seem to recall reading that DWTS built a studio in her basement so she would not have to be
away from home so much because of the kids.

She's not my cup of tea but what is she supposed to do exactly to support her kids? She is a single mother and needs to work. Her ex-husband should be out there busting his ass working so she can be a stay-at-home mom if he's so incensed about her working.

5. Just so I know, is Kate an alleged "star" on this show, or is she
just a well-known contestant?

I wonder if the McCaugheys, Dilleys, and Chukwus regret not capitalizing on their multiple-breeding with stardom.
