Let's just say I go to a CCW state
And buy a 9mm Glock - and walk everywhere, just waving it around

Would that be legal?

Just wondering...

4. Many states that have CCW - which is most of them now- won't sell a gun to

anyone from out of state. Waving a gun around is not a good idea and probably not legal in many areas.

I usually try to hide the ones I carry.

6. But isn't it my constitutional RIGHT to wave a gun around?
I mean, if they stop us from waving a gun around, the next step is the Gulag Archipeligo...

5. I think you need a special sticker for the waving part.
It seems too much like brandishing.

Most people get nervous around brandishers.

7. CONCEALED Carry.
Waving it around is an excellent way to become a statistic though.

8. Hey - not saying I was going to do it
But if CCW is allowed, then open carry should be allowed too, right?

And waving it around is the most open form of carry...

11. I don't think that's actually the case, that open carry naturally follows from concealed
And "waving" isn't just a special form of "carrying" - sort of like driving drunk isn't merely a logical extension of driving (stupid analogy, I know)...

10. If I really want to wave something around, I bring a shotgun...

Glocks are so.....small...

But you don't need to go to a "CCW" state - just buy yer gun ONLINE and have em send it to your local dealer. Here's a fair selection with a price for every pocketbook:

enjoy.

12. open carry isn't the same thing as waving it around
and like someone mentioned open carry may or may not follow (or coincide) with concealed carry.

14. Forgive me if I'm naive, but I can't tell if
you're being serious or an @$$hat. You don't really think that you can walk around waving a gun, right, even in open carry states?
I assume you're trying to push the buttons of gun owners?

15. Why would you risk your FFL on a charge of menacing?
Edited on Tue Apr-27-10 05:41 PM by Riftaxe
Must be nice to have enough money to piss away a FFL, assuming you had one to legally purchase a pistol in another state.

16. The right to keep & bear arms shall not be infringed - but it should be regulated.
Edited on Tue Apr-27-10 05:54 PM by baldguy
If you oppose the regulation of firearms, then you oppose the 2nd Amendment.

17. If you own the gun legally, you can wave it around as long as you're not waving
it around AT someone - or NEAR someone. Then have a good chance of being a dead CCW holder.

18. Nope. It's called "Brandishing".
Doing that can land you a few months in jail, not to mention permanent revocation of your CCW rights.

It's no different than a shovel. You can buy a shovel, and you can walk down the road carrying a shovel. Start waving that shovel around everywhere and you're going to jail, because that will be perceived as an imminent threat to public safety.

Rule #1 for firearm owners: Don't pull it out unless you have reason to use it immediately.
Rule #2 for firearm owners: Don't pull it out unless you are willing to use it.

Rule #1 for police officers: If you see someone with a firearm out, assume that they have both the reason and will to use it immediately.

If your reason isn't legitimate, you're going to end up in a whole heap of hurt. Assuming you end up anywhere other than a pine box.

Thanks for the fine example of anti-gunners high-lighting the inability to recognize the difference between "responsible" and "irresponsible". Posts like yours are a gift. Thanks.
