How to get unfair late fees and overdraft fees reversed

I read the other thread and wanted to post a separate thread because I finally solved the problem. Banks or any business for that matter, hate more than anything to have negative reports and complaints on their Better Business Reports with the Better Business Bureau. Other companies and people look at these reports to make decisions about their reputation as fair businesses. After contacting banks and being turned down to have fees reserved, I have filed complaints against the banks to the BBB. It works every time! The banks have to answer to the BBB when a complaint is filed. If you feel you are treated unfairly, you can file a complaint online at your regional BBB.

Also the outcome of the complaint has to be posted when the complaint is solved either negative or positive.

BOA bounced several checks of mine because I was given a "bad check" by an insurance company causing a negative balance in my account. After calling customer service, I was told there was nothing they could do, and I had to pay the overdraft fees totaling $225. I was furious so I filed a complaint with the BBB. Two days later I received a call from an executive in their main office who reversed all the charges and gave me a credit for the bad check I was given. Also I had late fees from Capital One several times when they weren't late, I again filed the complaint with BBB and sure enough, I was called by Capital One. They took off the fees. They don't want negative reports on their BBB. It's like their credit report from customers.

A teenager in our household was whacked with more than $500 in overdraft fees in a month. She kept buying milkshakes using a debit card, and the bank kept authorizing the charge even when she was overdrawn and then whacking her $35 each time.

I wish we had known about this.

5. overdraft fee question
Hello,

I found this post recently and wanted to ask a question, I don't know if anyone would be able to help, but if you could that would be appreciated.

On 12/8 I used my debit card twice (for two purchases). One at a convenience store and one at the grocery store. The bank debited the money from account immediately, and the two transactions showed up on my online banking list as PENDING.

As of yesterday morning, I had about 10 dollars in my account. When I checked a few hours later an automatic bill payment came in about about 92 dollars, which knocked my account into negative 82 dollars.

Best case scenario, I made two returns yesterday totaling about 90 dollars...if they posted overnight I would have been taken back into the postive by about then dollars.

Worst case scenario, I thought everything would post and i'd be negative 120 dollars b/c of a 40 dollar overdraft fee.

When I checked my account this morning, it was negative 200 dollars. What the bank did was post the 92 dollars FIRST, even though it was the last of the three transactions. That knocked my account into the negative right off the bat and caused a 40 dollar overdraft charge. They then posted/finalized the two smaller transactions which knocked me further into overdraft and caused another 80 dollars in overdraft fees.

I dont understand how they can do that, since the two smaller transactions occured FIRST and the money for them was already being held out of my account. Since they were pending before the larger amount even appeared, shouldnt' they have posted first. I knew I was going into overdraft, and I was ready to deal w/ that and get fined, but I believe the situation was handled improperly.

I have emailed the bank and awaiting a response, but I am not expecting anything to come of it. Am I right to question this, or do I have to accept that that is the way the bank works?

7. That is called stacking....
the newest way for banks to increase fees. Go to the bak the go to BBB if they don't come to terms with you.

In the olden days banks made money on interest-today they make money on fees.

9. I am up against Bof A for stacking
They ran up $296 in overdraft penalties over an $11 overdraft by re-arranging the transactions twice in just hours.

I wrote to the branch manager citing the law suit recently settled by BofA where they had to pay out millions of dollars for doing just this thing.

In 2010, the law will restrict this kind of piracy.

Fight this, and fight it hard. If we all stand together, we will win. Power to the people.

6. If you think they hate BBB complaints, try a lawsuit.
I had a credit card company pretty much on its knees. Unfortunately I had to let them go because I did get them to offer to dismiss their case against my client--they tried to sue her when they had absolutely no evidence that she had agreed to their credit card or that she had ever actually used it. Understandably my client didn't want to go after them for penalties and fees and risk losing the case.

If anyone has a good defense to a credit card company and they live in Cook County, Illinois I'd love to have a dozen or so of these cases.
