...They also want to test the legality of a nuclear fuel-rod tax, which Berlin introduced as part of last year’s deal with the companies to delay the phase-out of nuclear power from 2022 to 2036.

Beyond that, the quartet of power companies is reserving the right to sue for damages if the government forces them to close any of the idled plants after the current three-month safety review.

While the companies officially say there is no reason to close any of the seven plants because they are safe, officials privately reckon that Berlin will attempt to close at least two of them.

“That could conflict with the property rights of the companies and their shareholders,” one official said. “A lawsuit could easily go to the constitutional court”, the country’s highest court....

They "privately reckon" eh? Odd bit of logic that is....

1. they didn't lose any time
after the lost election. What is it going to be? "We are so sorry, we really really tried to reverse our decision, but it would be irresponsible to put another burden on the tax payer."
