9th CA: Gun case on hold

The Ninth Circuit Court on Thursday put on hold its consideration of a case testing whether the Second Amendment right “to keep and bear arms” restricts laws passed by state and local governments, and not just those passed at the federal level. After a hearing before an 11-judge en banc Court in San Francisco, the Court issued an order vacating submission of the case of Nordyke et al. v. King et al. (docket 07-15763), until the Supreme Court acts on pending cases raising the same issue.

Isn't SCOTUS deciding what cases they will hear today?

Under consideration by the court for Cert today. Might hear something by next week, possibly but not likely, late this week?

The summary, with all the filings, including AMICI, is near the bottom of the page on SCOTUS Blog.

Some very "creative" arguments from Chicago on why constitutional safeguards they don't like just shouldn't apply to Daley, I mean cities. If/when they lose I fully expect Daley to drag his feet for a decade or two on implementing the ruling.

These oral arguments are going to be interesting to listen to. With the circuit split on this, it's pretty sure to be granted review.

Of course if the NRA wins I'm sure "blood will run in the streets of Chicago" ... oh, it already is? Never mind.

In the meantime ... Father Pfleger is holding a march to ban all 2 x 4s in the city and state following the recent beating death of a young man by a mob of other young people with 2 x 4s from a nearby construction site.
