1. I'll tell you what I think.
The only reason I have not done the same on several occasions is that I did not want to end up like him. I have set up a trap in my back yard though and had animal control come out to take animals (both dogs and cats) away.

4. You don't have to. When people cannot take care of their pets someone
else will end up taking care of them, one way or another. If they were not in my back yard then they would not have been trapped in my cage and not made a trip with animal control. If they have proper tags then the owner will receive a call to come pick them up and pay the fine. That's just the way it works.

Edited on Fri Mar-19-10 01:49 PM by Taverner
And if someone shot at my dog, you can bet I'd be shooting too, but not at animals...

And the funny thing - I wouldn't do a day of time. Self defense and all

9. I never said anything about "RUTHLESS CHIHUAHUAS". I do however know
the annoyance that the little shits are to people that are not their owners. Bark constantly, get into trash, dig up gardens, leave little "land minds" at exactly the right locations, etc. If you cannot keep that dog out of my back yard then animal control will get it. The owner pays the fine or doesn't get the dog back.

If someone shot your dog in THEIR yard, you would hardly be justified in attacking them.
In fact, we have precedent here in WA. Someone killed his neighbors dog, neighbor flipped out, tried kicking down his door, dog-killer shot him through the door. Self-defense. Case closed.

24. The US has some of the stupidest self defense precedents on the books
We are the only country that gives out the privilege to shoot anyone for any reason as long as they are on your "PROPERTAY"

IN Europe, you have to PROVE self defense. The same should be the case here.

28. It's not the case across the country.
In WA, you have to be in reasonable fear of imminent harm. (Dog killer quite obviously had reason to be afraid)

In some states, I agree, the Castle Doctrine isn't perfect. I assume it will be adjusted at some point in the future.

Killed his neighbors dog (poisoned it). Neighbor comes over and tries to kick in his door, probably to beat the tar out of him. Dog killer shoots him through the door.

32. I disagree with that. The US has some of the most progressive self defense
laws on the books. And just so you know, self defense is not a privilege given by the government it is a right. And also, you cannot "shoot anyone for any reason as long as they are on your 'PROPERTAY". But I guess facts and the law do not sit well with your emotional state.

77. The Castle Doctrine allows you to use potentially deadly force...
to stop an illegal forcible entry, i.e. someone kicking in your door or forcing entry on your window. It does not allow shooting someone because they are on your property.

http://en.wikipedia.org/wiki/Castle_Doctrine_in_the_United_States

In general, one (sometimes more) of a variety of conditions must be met before a person can legally use the Castle Doctrine:

* An intruder must be making (or have made) an attempt to unlawfully and/or forcibly enter an occupied home, business or car.
* The intruder must be acting illegally—e.g. the Castle Doctrine does not give the right to attack officers of the law acting in the course of their legal duties
* The occupant(s) of the home must reasonably believe that the intruder intends to inflict serious bodily harm or death upon an occupant of the home
* The occupant(s) of the home must reasonably believe that the intruder intends to commit some other felony, such as arson or burglary
* The occupant(s) of the home must not have provoked or instigated an intrusion, or provoked or instigated an intruder to threaten or use deadly force
* The occupant(s) of the home may be required to attempt to exit the house or otherwise retreat (this is called the "Duty to retreat" and most self-defense statutes referred to as examples of "Castle Doctrine" expressly state that the homeowner has no such duty)

Edited on Fri Mar-19-10 01:58 PM by AtheistCrusader
I'm not a fan of handing everyone's pets over to animal control all the time, but for instance, where I live, roaming dogs are fair game. (Edit: to trap/detain for animal control, NOT shoot) If it's not in your yard, it better be on a leash.

And naturally, there are reasons for it, for instance, safety issues. I've had to jam on my brakes or swerve to avoid someone's fido, that was out roaming the streets illegally. Good thing I didn't make a mistake and swerve into something worse. Sooner or later, I'm going to end up in a position where fluffy is going to HAVE to go under my tyres, because there's a kid or something on the road.

I also don't appreciate cats and dogs tearing up my garden. That's a food supply. I WANT the birds in there eating the bugs. Usually I can shoo away cats, but if it becomes a problem, I may have to trap them for animal control too.

Gotta do what you gotta do. I protect the birds because they are valuable to me agriculturally. Some people protect birds because certain species are protected, and fluffy shouldn't be out eating them.

I agree with everything you said

But My problem is with the guy who wanted to BLOW AWAY dogs for being out the yard.

calling animal control? Awesome!

Setting up cat traps and calling their owners to get chewed out and pick up their cats? Awesome!

Whipping out a gun and killing dogs? Bad idea

That's my problem with the post

lady had vicious dogs come on to her property and kill some animals (she ran a rescue shelter) and bite one of her donkeys.

she absolutely would have been legally justified in shooting

and of course, unfortunately, the DOG suffers because the owner lets it run free

71. I used to have a tomcat that tried to hump everything in sight, including the dogs.
One dog was an elderly golden retriever that ignored the cat's attentions. The other was a miniature chihuahua that suffered greatly from the cat's abuse of it.

65. I think if it were one of my dogs he'd be glad he was in jail.

68. What about freedom to bare dogs?
It's getting late.

69. It seems pepper spray would be more humane, while also being very effective at persuading a dog to
stay out of your yard or away from you.

72. If it works on bears I think it could work on a horny chihuahua. :)

73. Two assholes = 1 dead dog
Mueller was wrong in shooting a little dog that wasn't posing a threat to another human, his dog or livestock.

Glasgow is a freaking idiot for stating Mueller was at fault for allowing a female dog in heat to be outside. If the dumbass had kept an eye on his dog at all times, it wouldn't be an issue.

76. A BB-gun -
- would quietly have solved this fellow's problem without killing anything or making anyone cry. Pop an unwanted stray pet in the ass with a BB and it won't be back.
